Chu T | I'm on month-to-month lease agreement. How much I've to pay if I'm going to move out middle of the month? |
I live in Glendale California, and I plan to move out on 15th of Feb but I've to pay rent on 1st every month, so on Ferbruary I have to pay rent for the whole month? ($1795) or I can pay only $928 which is 15 days out of Ferbruary? |
|

Landlord
|
The landlord is not legally required to prorate rent. You will likely have to pay the entire month of Feb.
Don't forget to give your 30 day notice, or you will have another month that you owe as well. |

How much was your deposit you put down? How much time did you give them before moving? Is the place being left clean and things broken are replaced? If so you should get your deposit back. In adition to the prorated amount. The amount owed should be prorated for the particial month. But, it all depends on your landlord. |

Your lease would normally address this. In Texas that would be the only way to answer this question because there is no law that says it has to be handled in a particular way.
I bet there is no law on this in California either. |

You really have to discuss this with your landlord, and put everything in writing. Or else you'll end up on Judge Judy. |

California landlord/tenant laws allow the tenant to give notice on any day of the month. This is one of the only states that allow notice to be given on any date.
If you give a proper written 30 day notice on or before January 15th, you are only liable to pay until February 15th.
To calcualte the prorated rent, divide your montly rent by 30 days (standard) and then multiply by the number of days you will be in the property. In your case, it would be $897.50 |

depends on when u give notice, u must give a full months notice normally from the first of the month so if u have given notice on 1 jan. u pay just rent till 15 feb. if u give notice on 1 feb the landlord is going to want rent for the entire month of feb. |

Rents are not prorated on a daily basis without prior agreement. In California, as in most states. a month to month rental agreement is considered to be a contract from the first of the month to the next first of the month. You need to give at least thirty days notice in advance of any rent due date for termination. You are then responsible for the rents for the next full month. |

you will probably have to pay rent for all of February and half of March (maybe all of March) It depends on what is in your rent agreement, and if you've given proper notice, in writing. Plan on paying for all of February, though. that much is almost certain. |

You are responsible for the full 30 days even if you move out early. |
