i'm in calif. been living in this house for about 3 years. it was an agreement between the owner and i to deduct any repairs that i do to the house off from my rent. also i was working for him with the same agreement. when rent was due, he refused to do any of the deductions, and demanded his rent. so i refused to pay him the rent money. it is now 2 1/2 years later. i still have not gave him any rent money, so basically he agreed to let me live in the house rent free. now, all of a sudden, he says to me that i have 2 weeks to move. i am not prepaired financially to move at this time. can he evict me just like that? please help! |

NO HE CANT, I have been in this situaton. he needs to file papers for an eviction. unlawfull detainer, only the sheriff can physically evict someone. Tell the douch you'll see him in court. you have rights because you live there. it does not matter about lease or agreements. you have rights |

I know in Michigan, the landlord has to serve you with a legal eviction notice, and that notice gives you 30 days. You can check online to see if your state has any laws protecting the tenant from unlawful eviction. You should feel greatful for being able to live rent free for as long as you have, and not try to push it. You faulted on your side of the agreement by not paying any rent... You are at fault too. Do not make him take you to court, you might end up owing back rent for two-and-a-half years...OUCH! |

if your lease is expired or you aren't living up to the terms outlined in the lease, he can do whatever he wants.
You should feel blessed to have had a place to live for 2+ years without paying anything.
What do you want? You have no chance in court on this one.
The judge will eat you alive if you even try to reason that you deserve to live on someone else's property rent-free. |

If you don’t have anything in writing and documented then he can do whatever he wants he doesn’t even have to give you 2 weeks if you do not have a written agreement.

this is real shady because i dk if you signed anything to the effect stated in your claim. besides, if he was letting you live there "rent free", you should have known that it would end eventually and saved your money. as it stands, he'll be able to get the sheriff to forcefully evict you in 30 days from his first request. however, if nothing is in writing, like, for example, your agreement with him, y'all can drag this out for another 2.5 years.

I'm sure he never agreed to let you live rent free for 2 1/2 years.
Legally, he needs to give you 60 days notice (Calif. law), however he can require you to pay.
How can you not be prepared financially???? You haven't paid rent, so you must have some sort of savings. |

I'm not a legal expert, and I live in Kansas. Specifics regarding your local law should be directed to the local Housing Authority.
However, if it were here in Kansas, yes - what he's doing is perfectly legal. Although a verbal agreement is 'technically' legally binding - there is really nothing stopping him from denying your agreement of repairs for rent ever happened. This is why deals like that should always be put into writing.
I'm very sorry to hear about this - and maybe there is some legal protection for you in CA. Again, check with the local housing authority (city or county, depending). Good luck! |

only a sheriff officer with a court order can remove you from the premises period, the landlord may not take action into their own hands and must use the courts, any action by the landlord alone is called self help and is illegal |
