I am 5 months in a high risk pregnancy can be evicted?
I am currently 5 months with a very high risk pregnancy and a 2 year old. I was recently hospitalized for bleeding due to stress on the job. I am currently on permanent bed rest for the remainder of the pregnancy. With that said, my landlord recently ask that we vacate the apartment by Oct. 1st as he will not be renewing the lease. We are up to date with the rent and have never missed a rent payment. He is currently in litigation the downstairs tenant for renting her an illegal apartment. We were told by the city inspector we can file suit ourselves since the house only have one exit for the entire home. Since we have access to the basement for laundry purposes, the home inspector stated that it would put us in danger if something would happen while we were in the basement.
Can we ask the landlord to allow us to stay in the apartment until I give birth in Feb. or is there some legal ramifications I am not aware of?

If he says he is not renewing your lease, you can try to ask him if you can continue on a month-to-month basis. If he doesn't agree, you have to leave. The end. It isn't his fault or problem that you got pregnant. It's yours. You can't expect him to care. It's business.

I have three kids, ALL high risk pregnancies. They have nothing to do with your rent.

EDIT: To the answerer above me, he DID give you an explanation: he is choosing not to renew your lease. And he doesn't have to renew your lease if he doesn't want to and he doesn't have to give you any reason at all.

You have a lot is issues here, that are not related

Being with child has nothing to do with your lease term.

You said it your lease ends by October 1, 2008

If you file a claim on the landlord, that will not extend your lease.

If the place is determined to be unfit to live in you may be out before October 1, 2008.

I see no easy out for you but to move before you are evicted.

Sorry, your options are few.

The home inspector is talking out of his ****. You can not file a suit just because you used the basement for laundry....besides, what would you file suit for..you have no damages.

Anyhow, the status of your pregnancy has nothing to do with the law. If the landlord wants you out...then that's the way it is. You can try to talk to him and explain your situation...but he is under no obligation, by law, to accommodate you.

The landlord does not owe you an explanation as someone else stated. It sounds as if your lease is up Oct 1 and he is not choosing to renew it. The fact you have a high risk pregnancy is also not an excuse to get an extension. An extension is in the hands of the landlord. Now, the other illegal things that you mention the landlord may or may not be doing is a whole other can of worms, because if you call the building inspector and he deems the property unsafe, you would still have to move, because he can condemn the property until the landlord makes the corrections! I would try to find another place to live if I were you as, I don't think this is going to go well either way.

LL is afraid of liability and local government may have told him he has to empty the house out. If you want to stay, need to give the LL a HOLD HARMLESS agreement and go to month to month tenancy. City inspector probably overstated the case to you. . . .sue for what? what damages? if you were trapped in a fire, yes you could, but now?

Do you currently have lease? When is it up? Did government post the property? Not enough info. . . . .

We need more info. Are you on a lease? Did he give you 30 days notice?

If you are on a lease he cannot just ask you to be out for no reason.

Unfortunately your health issues and pregnancy have nothing to do with your rental situation. You get no special treatment for being pregnant. Not fair - but legal.

I think that you should start looking for a new place just incase the guy is he won't do it. If you cant do that which you are on bed rest you should live with family until the baby is born.

I wish the best for you. I've heard of landlords going bankrupt and losing their rental property, and they just throw everyone out. It might be worth it to just move if you can afford it. I would contact social services for some temporary help, and ask the case worker at family services for some advice. I wish you the best of luck. What a crumby landlord.

Check you State and Local Law's regarding Renter Rights,
You also might have some Justification under the Disability Act because your considered disabled by a Legal entity "Doctor Office", "Requirement of Bed Rest", Look at all Government, State, and Local levels.. and Also you can ignore the eviction and Fight it in the Court System.

Check your state laws. It sounds to me like he just wants to get rid of you becuase you are going to have children! I'm pretty sure thats not legal.

Ok, first of all he can't just put you out without an explanation, esp. if you have been paying the rent on time. He has to give you an explanation, or you can file a lawsuit against him, for that or discrimanation. I have found that many people where I am from don't want to rent places for people with children, which is pretty harsh considering the fact that almost everyone here has a child or four.
