I am a Tenant in a privately rented house. and at the moment im having problems with my shower?
for the past 2 months its started to breakdown ive been onto the landlord about it he said get a quote i got a few quotes he said there all too expensive so a month past and landlord contacted me and said im going away on a trip as he in army and he wont be back for 6 months and he wanted shower done before he went 3 days later we contacted him and he had gone. he didnt leave no contact number or nothing and there shower is totally broken its costing me a fortune running a bath all the time. should i just get a new shower fitted and pay it with the rent money? . because the landlord wont be back for 6 months ? HELP!?

it is a power shower and its actually stopped working all together but when switching on the noise is so terrible both my next door neighbours can here it very clearly. thanks to all who posted i appreciate all your comments. :-) :-)

Wow, that's terrible! Your landlord should have got the quotes himself and scheduled the repair service in conjunction with your needs/requests.

If it were me, and I couldn't deal with living without that shower (no other option in the house) I'd have it repaired and send the bill to the landlord. And, I'd pay my rent to an escrow account until I was reimbursed for the costs or the landlord deducted them from my rent.

You may want to seek some legal advice however, since laws differ by State. (And check any clauses in a contract you may have signed.)

For future reference, it's a good idea to put EVERYTHING in writing when you deal with your landlord. Next time, write him a letter describing the problem and send it certified mail. This way you have it documented that you asked him to fix it. All you can do now is wait for him to come back and fix your shower. Or, have it fixed and present him with the receipt so that he can reimburse you. If he refuses, you'll have to take him to small claims court, and it's probably not financially worth it.

Document (write it out) what you have said and done, to this point . . .
Send a copy to the owner . . . (where you send your rent)
Inform the owner you shall now repair the problem, and deduct the costs (from the receipts you keep) from the rent you will owe, for however long it will take to cover the costs of repairs. . .

There has to be someone that is taking care of his affairs while he's gone. So you might want to review your contract and see what else is taking care of it. If you can't find anyone then how are you going to pay your rent? or to who? contact them about what's going on.

If all else fails hit them were it hurts. Get the work done, send them the rent check less the work you did and the bill with it. Because he's military you might have a problem with JAG. If you have documention on everything then you should be okay. If it goes down a legal route I'd also sue for the increase in the bill for the water as well. Despite the fact he's army he does have a responsibility to take care of his affairs. In fact if you wish, go talk to a lawyer yourself.

I agree with the two above me.... and yes, you should have requested the repair in writing long ago. To truly cover your butt, find out the laws regarding landlord and tenant laws in your state. Send a certified letter to his last address requesting the repair be made in 72 hours or you will have it fixed on your own and reduce your rent by the amount of the repair. Yes, I know he is out of town, but you sent him a letter... not your fault he's gone. Keep the return receipt and a copy of the letter. Write down everything you can remember from your prior conversations about this repair... call a plumber. Happy showering!

What is wrong witht the shower? Is the shower part of the tub or is it separate? Who/how do you pay the rent if he is gone for 6 months?

fix the shower, pay for it, submit the reciept for the repair with your next rent check, the amount of the rent reduced by the amount of the repair. He should have fixed the problem before he deployed.

Read thru your rental agreement and make sure you wont get in trouble, but yeah that sounds like a good plan, get it fixed and send the receipt with your rent short by that amount. Also, keep records of all your conversations and requests in case he flips out about it, then you can show that you requested it. Also, research the laws on it your state if you really want to be protected.

I think you will be okay, sounds like it was not so much a money thing, but that he just did not want to mess with it!

I'm not sure of your rights as a tenant, it may be worth you asking Citizen's Advice.However, with the current warm weather and no doubt we'll have the usual hosepipe bans, you do need a shower rather than a bath.Get the cheapest shower you can, make sure you get the electrician (assuming you don't fit it yourself) to give you a receipt.Then thrust it under your landlord's nose when he returns.
