I am a landlord, my tenants pay only portions of the rent when they feel like it. I feel like I am harrassing?
them but now here it is the 10th of the month and I have only recieved 1/3 this months rent. They said they would pay the rest on 11/6 and Istill havent seen it. They will not answer the phone, and they have a carpet cleaner and ladder of mine I want back. I guess I have 2 questions, 1 can I enter the property as being their LL to get my property back, and 2 can I evict them for not paying rent, since they pay it sometimes, when they want to. I have already put a for sale sign in front yard. But I need my rent $ from them, they do the same thing every month. And they dont pay the late fees, and now the screen door is ripped and the garage has been hit, with what looks like, a car. Give me some advise please

Contact the court and have an eviction notice sent to them.
You can go to the door, knock and tell them you need the carpet cleaner & ladder back...take someone with you when you do this. You can also contact the police and ask for an officer to be with you if you feel uncomfortable doing it alone.

Take photos of the garage damage, and any damage they do or have done...you can sue them for damage.

If they vacate and leave their things behind, then it becomes your property and if it is worth anything you can sell it for rent money owed to you.

My advise would be to stand up for yourself and your property or get someone over there that will do it for you. You are being taking advantage of and you are letting it happen. Take charge.

Check the lease you had them sign - talk to a lawyer and file the papers to have them evicted. The rules on you entering the property vary by state but you typically can with notice.

Go to the courthouse in the county in which the property is located and file an eviction notice. Someone from the county sheriff's office will serve (deliver) it to them. I doubt you will get your money. They will probably sneak out in the middle of the night, never to be seen again.

if you made a contract with them eg. tennants agreement. you have full right to go and speak to a lawyor or solicitor.
also try and get proof that they havent payed you or of any damadge they may have caused because this can be used as evidence.

If this happens one time, you can be nice. But this seems like it's become a pattern. To enter the property you have to give them notice. You can call a lawyer now, and start eviction proceedings. I hope you've kept good records showing how they pay erratically. You could also send them a letter with a return receipt so you can prove they got it, outlining that you will no longer tolerate skipped or late payments, and if it happens again, you'll start eviction. I would call a lawyer and dump these losers now, as long as you can rent the place again. I hope you got a deposit because they've caused some damage and I wouldn't expect them to repair anything.

You are your own worst enemy. Some people will take advantage of nice, easy going landlords. Basically, you have picked bad tenants. You need to bid them farewell. You may have to incur some legal costs to do this quickly and cleanly. I know it may seem harsh to you but you are being made to suffer because of their selfishness.
Next time, learn from your mistakes. Be very careful when interviewing prospective tenants and take as much time as it takes. I don't wish to insult you, because I don't know your age, but it may be helpful to have a second opinion. Such as a good friend who is mature and experienced, and may detect something you don't at interview.
The main thing is you need to find tenants that are respectful to you and your property. The more interviews you do the better you will get at it. You may have to turn down many applicants, but you have to be as sure as you can be to avoid future problems.

I was a landlord once this is how I dealt with it one do not be friends with your tenants do not loan them anything when they see you as a friend they wont take you for serious so be firm when going to collect rent from them and yes you can evict I think it starts with 30 days then 60 and almost sure 90 I think it depends if they have kids how long it will take to evict if and when you do evict I would start fresh and screen people even if you have to ask for several months rent ahead of time or writing a lease up with the next people you let rent because a lease has to be honored in a court of law good luck hope this helps

Go get yourself a lawyer and start the eviction process. eventually you will get all your money. It is the downside to being a landlord.
