I am a subcontractor, I get paid 60% of all work completed. He tells me he is having problems collecting money, supposely $50,000 is uncollected from 2005. But he went to Vegas for a week in April. If you are an employee ( taxes taken out of your pay) Go to the Social Security office near you and file a claim.
If you are an independent contractor, that is you file taxes separately visit your local Labor Board and file a complaint.
Also you may take to him to small claims court for a very nominal court fee.

Depending on the actual dollar amount that he owes you, you might be able to take him to small claims court. This is pretty simple you won't need to hire an attorney for this. I don't know the limits but I think its $5000.00 anything above that would have to go to district court. If you can back up your story with proof you should have no problem winning your money. Just gather all information pertaining to the jobs that you did for this person in the last five months and be prepared to state your case. I would send him a letter threatening to take him to court give him so many days to respond with the money and if he doesn't then take him to court he will know that you mean business once he received the court papers. While your at it, you need to file a complaint with the labor commission so that you can warn other potential employees that he might not be worthy of paying for services.

Partly it depends on how you were paid. Were you salaried, paid a wage, received a commission or were a contracted person.

If you operated on a contract as a nonemployee your only real option is to take him to court.

If you were one of the other types, it depends on the situation. Why wasn't he paying you? Likely it was because he had no money, or was going bankrupt or is now out of bisiness. If that was the case, you may have no recourse except to sue to get what you can.

If it was that he had money and simply didn't pay you, then tell him you'll bring his failure to pay to the attention of his clients (real estate agents and banks hate to hear about debt/wage issues for providers) as well as complain to your State's Department of Labor and the Social Security Office. If he doesn't, then start going around and complaining, and sue.
