I am a tenant and a debt collector threatened to put a lien on the house we rent. Is this legal?

They can't put a lien on something you don't own.

lostinlove
No one can put a lien on something you do not own. They are only trying to scare you. Collectors are not supposed to threaten you anyway. You need to get caller ID and just not answer the phone when they call or file bankruptcy and then it is illegal for them to call you.

Yes it is legal. Your landlord probably was not paying the taxes on the property and if you are in Michigan the landlord is always "right". Sorry, you could always go to court and ask the judge for time to find another place to live -god be with you

BaFfler
No, and it's impossible too.

Tell the debt collector good luck that is so ilegal that it is not funny they are just trying toscare you in to paying them.. Do not fall for it tell them to kiss you A$$ & that you will pay the bill when you pay it.. Good Luck...

cracker
Did the debt collector perhaps mean he/she would file a lien on your wages rather than the rental house itself? I think only an owner/landlord can initiate a civil suit for monies owed in rent. In my state, a tenant must be legally evicted by the owner/landlord only and then file a separate civil suit. A debt collector can do nothing more than try to collect the debt for the landlord.

Let him put the lien, its not your house. Actually he can not put the lien.

cecilia4realestate
Absolutely not. You would have to have a financial interest in the property or be on title of the home for them to put a lien against it. They are using "scare tatics" to try to force you to pay them. Most of the collection agencies are using illegal methods of collections and if you do not want to be harrassed by this collector or have them phone you in the future, simply write them a letter asking that they only contact you via mail. Send the letter certified mail to get a receipt and then if they continue, you can possibly sue them in court for harrassment! You owe them money, but you have to let them know that you still have privacy rights as well.

No, it is not legal. I do not see how they can put a lien on a house that is not yours (I understant that you rent the home and the mortage is not yours).

unique401301
Actually it could possibilty be legal. but it would have to be between the debt collector and the owner of the house

No, you do not own the property. This means you do not have any equity in the home. Therefore he can not put a lein on the house with your name on it.
