Well, its not exactly that simple. You certainly don't have property ownership rights and the consistent paying of the same amount each month (as well as emails and letters between you and your landlord) will "become" the lease, if not reveal it. However, when there is no written lease, it actually hurts you, not help you. When there is a lease, you can negotiate default terms and eviction terms. Now, you're subject to the law. They will file a 3 day notice to pay or quit (if they are aware of the process. They cannot evict you without this). If you don't pay, they will probably file an Unlawful Detainer action. When you are served the Summons, you have 5 days to respond. ALWAYS RESPOND! This buys you more time. If you don't respond within 5 days, the clerk can enter a default and you can be out in a week. Once you file a response, you will get a notice of trial in about 2 weeks. Usually, the court date is 3 to 6 weeks away. You should attempt to pay (even if its part of it) any time you get a chance. If they accept any payment after a 3-day notice is issued, they are required to issue an updated 3day notice. If they don't then you can go to court and ask that the 3 day notice be quashed because it doesn't reflect the payment made. The judge will order them to re-issue and the process starts over. This buys you more time.
REMEMBER: this is just to buy more time to eventually catch up, not to screw someone over. That comes back hard and ruins your credit. If they get an attorney, expect to move in 4-6 weeks total. If not, you're fine. Eviction is a legal process and knocking on your door and saying "Sorry, but we've decided you gotta get out by Friday" will not do and is illegal. |

with no lease if your rent was paid on time they can give you a 30 notice to get out. At that point if you don't leave the can take you to court to make you leave. But your rent is not paid so if you are a full month behind they can give you a three day notice to leave after that if you don't they can take you to court to get you to leave. You are better off if you leave with out them takeing you to court that shows up on your credit and background check and then you can't get another place to live. |

They can still give you 30 days to get out, because the home does not belong to you. You still have rights, meaning the right to your obligation to the home owner. Why would you think you have to leave if you are behind? Some people will work with you. Shouldn't a hand shake work? If you told them that you would stay for a year, then you need to stay for a year. Just because there is no lease, why would you won't to take advantage of that? People like you hurt it for the rest of us! |
