Lady Bug 5383 | I am being audited from 9 years ago, where can I get old bank statements/etc if my bank no longer has them? |
I am being audited from so many years back, and I do not have statements of my own. I need to prove where I spent my money but my bank doesnt have the statements. What in the world can I do?
Also...the audit for approximately 2 million dollars. My husband was a building contractor, but unforunately we filed for bankruptcy the next year. With high interest payments, and us not getting our money back that it took to build the homes, we went under.
Our real estate attorney is out of town, IRS is closed for the weekend, and my bank does not have statements that go that far back. I have a huge problem on my hands....where can I get my old records??? Thanks Additional Details My husband filed in 2008, he waited so long because we had moved, he was in a deep depression, everything went downhill
also the federal bankruptcy attorney shredded all of our paperwork. |

you are only obligated to keep records back 7 yrs. Check with your company atty
and see if I am correct.
and you are in no rush to get this letter from the atty.
IN court, no judge would require anyone to keep records that far back; they would
tell anyone; even the IRS; if you had cared, you would have come forward earlier.
We have a component of law called SPEEDY TRIAL. [same with getting records.]
IF someone, even a gov body, wants records, they have no real expectation to
get anything that far back.

If you (or your then lawyer or accountant) don't have them and the bank doesn't have them, you are out of luck. |

So you are being audited for 2001 tax year that you just filed in 2008? Well, if you had the paperwork 2 years ago when you filed, 6 years after the fact, the IRS is going to expect you to have the paperwork you based that filing on 2 years later. The IRS does not care if you are having problems, if your cat died, if you have an ear infection, etc. Bottom line is you had to have had this paperwork in 2008 to have filed it, and if you don't have it now you are going to have problems proving any of your deductions. I don't mean to be harsh, but the IRS is ruthless and you are going to have to try to find that paperwork. |
