I am buying a FSBO home. Who's lawyer typically writes up the purchase contract: buyer or seller?

Even if the seller brings in their attorney you want one on your side, making sure your interests are all covered.

Take your own lawyer. Pay the $200 bucks, don't forget an inspection, pay the 250 bucks for that too, otherwise you regret the day you are born in a couple of month.

flamingojohn
I would use your own attorney, or at least have your attorney review the contract. It will be worth whatever they charge to make sure the contract is not written in favor of the seller as to closing costs, fees, etc.

frankie b
LOL. Why does it matter? If you don't know who writes it, why would you think it will be written correctly? Just hire a lawyer and stop being cheap. You will be happy you did.

Either way get your own attorney to read the contract. There’s so much legalese involved you’ll want to be sure you understand what you’re signing.

There is no typical in this situation, it is whatever the parties work out. I would definately have your own attorney review the documents.

It doesn't really matter too much, most of the forms are standardized, and each attorney crosses out or adds things to the form until they are satisfied their clients interests are protected. Then they produce a clean copy for everyone to sign.

Mark
If you use title companies you can have them assist as well. The title attorney represents the contract.

Typically the Seller's attorney will handle all the paperwork. Including holding any earnest money that is put down. Though make sure you do get your own Attorney to protect your interests.
