tea | I am buying a home and the broker is threatening me, using information I supplied to get the loan against me.? |
He says if I don't give him all the money in my bank account then he will not sign off on my loan. The loan company signed, the title company signed... but the broker will not sign. He says he knows exactly how much money I have and that I can afford it. He also said that if I refuse to give him the money he will the alert the loan company that I don't have the funds needed to buy a home. I know this is illegal but I don't know what to do. Additional Details I do have money to buy a home, and I have a good job with a good salary... He also said something about that on the call... He has called my work and my home. At first he was asking for 4,500... Then he went to 3,600... as of last night he wouldn't sign unless I gave him 2,300. I have been trying to close on the house for three days now. He is the only thing holding it up. I just don't want to lose the house, but I don't want to pay money that was not written into our agreement. |

Why isn't your lawyer handling this for you? |

Contact the Real Estate Brokers Association and report him. Tell him to F-off, you don't need a house that bad and find another broker. Tell the loan company. Tell anyone that will listen. You are right, it is illegal. Tell the police, like the District Attorney's Office. |

found out what company he works for and report him - in the meantime - walk away and don't deal with him anymore - he must owe the mob money and is desperate to pay them back so they don't break his kneecaps - call the police too - sounds like extortion to me |

I would contact the mortgage company directly if you know the name of the company. Le tthem know what the broker is saying to you. Or you can go directly to another mortgage broker to let them close the deal.
What he is saying bears no wait to the mortgage company as they are the ones providing you the loan, not the broker, he just located the mortgage company for you. After all they have all your account information, correct? In order for them to approve the loan they had to have all of this information upfront. The other option is if he works for a company and is not the owner, then you need to go directly to his boss and explain that he is holding up your loan for extortion fees.
You do have a recourse. The loan company will start inquiring in a minute. They will want to know what the hold up is. |

You are being defrauded and you don't know what to do? First call the police and have him arrested for blackmail and fraud.
Second, advise the bank that the broker is a crook and that they shouldn't do any business with him. If you paid a down payment for the house try to get it back and find a different broker.
Third, if you have any criminal involvement yourself, get a good lawyer.
Find out who licenses the real estate brokers in your state and file a complaint.
Oh yeah, get your money out of that bank and into another one pronto. |

Do you have the funds to buy the home? What kind of broker? Loan broker or real estate broker? If realtor, go to the local board of realtors to report it and for assistance. If loan broker, they are licensed by the state, so go to the state dept that licenses loan brokers. You can contact the lender directly and explain the problem. DON'T pay this scumbag. |

The broker not only is acting illegally, but anyone who knows about his tactics could expose him and cost him significant amounts of business in the future. Maybe he needs to be reminded of that fact.
Can you not fire the broker? |

THIS IS ILLEGAL- contact the licensing board and file a complaint - the consumer can not be forced into the transaction nor can the action be disolved once the seller has signed- he is trying to extort money from you because he makes less now than he used to- review the broker contract you signed to see if there is a minimum earning requirement. Sounds to me the broker needs to be stripped of license and doing time. What state? Also call the other parties and have them become involved.
I have checked with my broker and almost every mortgage lender considers this an act of MORTGAGE FRAUD- most states shoot for jail time and the Business will have to release their license because of the fines and damages. Call and speak to the Principle Representative of the Mortgage Brokerage company he works for- this violates the fiduciary relationship a mortgage broker is bound to. The laws state he is to protect the borrower and the lender- not extort money or willfully commit fraud. |

Is this the mortgage broker? That's illegal. You need to contact a lawyer and talk also talk to this broker's boss. Also talk to your Realtor and have them contact the title company. Then you need to contact the proper authorities, because if he's doing this to you, he's probably extorting money from others. |

Call the State banking authorities as well as federal bank regulators. You either qualify or you don't. If you don't then you shouldn't be buying. If he lied to the mortgage company he may be going to jail. If you did as well you can go to jail.
Try a new loan broker and see if they can close faster. |
