The owner can sell for whatever they want. The problem is if your getting a loan, the lender will base their loan amount on the Appraised value. |

The seller does what the seller wants. The buyer does what the buyer wants. The bank does what the bank wants.
Here's who cares about the appraisal - it's the bank. The bank lends based on the appraisal. They don't care what you or the seller think it's worth. They listen to the appraiser.
You can pay more than it's appraised for if you want to, but don't expect to drag the bank into that argument. They don't care what you think about that. |

The owner will set his price, however, the lender will not pay above the appraised value. If the buyer does not bring his price down, he will have to wait for someone to submit an all cash offer. Its the only way to get a house for more than the appraised value. |

A contract can be negotiated between buyer and seller. The sell price is the amount that both agree on. You can only get a mortgage based on an appraisal meaning that if you are getting a 95% loan then the loan will be based on the appraisal or the sale price which ever is less. The seller my not be willing to sell a home if they do not get a certain price. |

The owner can ask whatever they want for their property. The only time this becomes a problem when your mortgage lender will only lend against what the property is valued at NOT what the owner sold it for. |

God Bless America! As a seller, you can ask for whatever you want. As a buyer, if you've got all cash and that's what you're willing to pay, God Bless You as well. However, if you need a loan, typically an appraisal is required. Typical lending practice is based upon the sales price or appraisal, whichever is less. If you so choose, the difference between your loan and the purchase price can be made up in cash, or potentially with creative financing from the lender or owner. Assuming the appraisal is accurate, it is a rare occasion when you should be willing to pay more than the appraised value for a property. The fact that you ask this question would lead me to believe you might not recognize when to do this, or when to re-negotiate and/or run. I believe sound advice at your current level of expertise would be not to pay more than an independent third party deems the property value to be. Best of luck. |

Absolutely - the price is negotiated between the buyer and the seller. A smart buyer should know what the house's value is in relation to similar houses in the area - but the house might offer them something they really really want (like a great view) and they are willing to pay more for it.
An agent might not like to list it higher than appraised simply because it might make it harder to sell - but in the end, they'll get more money if it does sell.
There are different kind of appraisals too - tax appraisal, real estate appraisal, insurance appraisal. |

You can only sell what someone is willing to buy. It's up to the buyer to how much they want to pay. If the asking price is more than the appraisal you will need to come up with the difference in your down payment or take a second that the owner may be willing to carry. In this market there is absolutely no reason to over pay for a house, negotiate, it's a buyers market. |
