My landlord has been horrible. The apartment I lived in was overgrown with mold, unbeknownst to me upon moving in, and when I informed her of the situation she painted over it ,which does nothing to kill mold. The water heater pipe burst and water went all in the closet the heater was in and ruined clothes I had there and the carpet and she did nothing but duct tape the pipe allowing it to burst again. The yard is never mowed and she won't spray for bugs. The roof also leaks and there was a very bad leak a few months back where water was standing about 2 inches deep in the kitchen and she accused me of leaving the sink on. The water seeped through the ceiling to ruin my pillowtop mattress on the ground floor - there is now black mold all through the mattress. She will never accept my rent though I pay months in advance & is very rude. Threatens to evict us for no reason. She promised to pay for garbage pickup and hasn't. I have pictures of these things - how else can I prove my case? |

First of all, get all the documentation you can on all the things you mentioned. The photos are a good start, but you need something on paper as well (i.e. plumbing receipts, etc). Another good way is to get a pocket sized voice recorder and record your conversations with her regarding these issues. Anything she says can be used as evidence in Civil Court.....good luck! |

affter all of this why dont you just pack it upp, chalk it up too experinces and just hit the highways and get out from under this so called rats nest or dump your living inn?? with all of this we arent suprised you dident have a row boat in this dump with the water leaks, and headaches, i would have put a match too something like this dump. just get out and hit the highways the landlord is a slum lord, and wont admit too anything, what a mess. |

you need more than pics you have to have WRITTEN proof and on file with the county housing authority. Take your case to them if what you are saying is true you have a case. fter that get an attorney that specializes in landlord/tenant disputes. |

Take pictures of the water heater pipe burst, the damages of your ruin clothes. Take pictures of the duct tape that allowed the pipe to burst again. Take picture of the yard that was never mowed. Video tape of the roof leaks and the water that was standing about 2 inches deep in the kitchen. Take video tape the water seeped through the ceiling that ruin your pillowtop mattress on the ground floor. Take pictures for the garbage was not pick up and dated when the garbage first started. You need to leave immediately before the mold kills you. Mold will kill you. I had to move out because of the mold. Bring people such as neighbors, family members, friends, or any one that is over 18 years old that can be a witness to testify about the mold (mainly the mold)
You need to leave immediately and give 14 days for the landlord to give you your security deposit and send her the total bill for all of the damage to your clothes, pillowtop mattress. If she doesn't give you your security deposit within 14 days and reinburse you for the damages, find out about the state if it is 30 days or 14 days. Find out what rights you have with all of the damages. Then sue the landlord immediately for your deposit.
The landlord will have to tear down the place due to the mold and the severe water leak, which will take months to fix. |

Oh my, that sounds like the landlord from HELL ( excuse my French, but OMG. Pictures are the perfect thing to have, also if you have a notebook or pad with times and dates you have called her, copies of any letters and receipts if they were mailed certified. She cannot evict you for no reason so that shouldn't be an issue. Do you have a lease? If so you will definitely need to read the lease and make sure you haven't violated any issues. From what you have stated it does sound like you have a case it depends on how much you want to do, as far as small claims court or if you can/want to go higher. Every state has different laws and you may want to do some research to how much you can sue for and if there are any other incidentals you can ask for. As long as YOU can prove that she broke the lease then you should have no problems. You can also check with attorneys in your area and get some advice from them, some offer a free consultation others may charge you a small fee.
