First talk to your lender. Let them know exactly what you are going through and see what they can offer to help you. Most lenders have various ways that they can help out. A forbearance w/ your lender may help out and temporarily suspend payments for a few months while you either try to sell or while you try to gain control of things once again. After the forbearance period a loan modification can be done to add the back payments that you missed on to the end of the loan. The lender may also be able to give you a lower rate or lower your payment temporarily to help out for a small amount of time. This will be your best option before considering bankruptcy. If things get worse and you have nowhere else to turn and/or the request for help is unsuccessful with your mortgage company then sitting down for a free consultation may be a good next step. In order to file BK you will need to do a short consumer credit counseling course either online or over the phone to analyze your income and expenses and to help you figure out your finances. The USDA is generally very accommodating with regard to assisting individuals with their mortgage payments. You may want to contact them and arrange a 'written' modified repayment plan that will afford you an opportunity to get on your feet while you are waiting to sell the property.
It is very important that you do not ignore the notices sent to you by the USDA.
Although bankruptcy is an option, whether or not it is your 'best' option will depend on your particular circumstances. Take a deep breath - don't panic - don't ignore the USDA - and plan a strategy that will be in the best interest for you and your child.
If you have equity in your property, contact an investor that will work with you within your time frame. An investor obviously has an interest in making a profit, therefore, their offer typically will not be as high as offers through a routine sale.
However, if you really need to sell quickly, selling to an investor is another option.

You may want to have a short sale ( which the lender is willing to take a hit if the home sells less the what you owe on it), most of the time and in this type of market they're more than willing to help. I recommend you contact a Realtor that have done short sales. This way you dont have to file bankrupcy and save your credit. |

The first place you need to call is customer service and speak with someone in the loss-litagation department.
Remember that the LAST thing a lender wants to do is foreclose on a property, and there are vast options available in order to give you time to get back on your feet.
They will usually bend over backwards to assist you, if they know your situation is critical, and the better your payment history, the better your litigation power.
If worst comes to worst, and you cannot reach a settlement, do a Deed-in-Lieu...this may prevent you from getting a deficiency judgement against you, in the event the sale of your home does not cover the balance of the loan plus fees.

Filing BK will help with your other bills- but not your mortgage. You are probably better off just trying to sell it or possibly lease it out to someone else for more than your payment to not only cover that, but give you a little extra cash too. |

Yes, check with your mortgage company to see if they can rearrange your mortgage terms and conditions. Companies are more willing to get something rather than getting ZERO
through bankruptcy. If talking with your mortgage agent does not work, your local Legal Aid Society might be able to give you guides but you have to act fast because your creditors are not going to wait for you. |

First, check with your mortgage holder. A lot of them have special programs for people to help gat caught up on their loans. If that doesn't work, check with a free legal aid counselor in the are and they can advise you on the bankruptcy. |

You probably want to speak to a credit counselor about your question and situation. The credit counselor would tell you the pros/cons of bankruptcy and will tell you if there are other alternatives other than bankruptcy.
And depending on which credit counselor you go through, the first consultation may be free. |
