I recently sold my mobile home. The couple that bought it came to look over the place 3 different times. I have signed over the title for the property and have received all money from the couple that bought it. Since I signed the title over to them that makes the mobile home their property, no longer my problem. Well today they called me, and were fussing that there was some sheetrock dmg. Rewind to the 1st time they came to look at the mobile home. I showed them every ding I knew of including this one. Keep in mind this is a 10 yr. old mobile home, so of course it will not look brand new, if they wanted that they should have gone and bought a brand new one. On the bill of sale, I made it clear that no warranty was implied at all. We both signed the bill of sale and title....its a done deal. What do you think? |

Oh, you didn't have an attorney? Yeah, selling or buying a home is such a trivial ordeal, I can see why it wouldn't be important to have one!!
They would have to sue you to try to get anything done about this, so perhaps you may want to wait until you get served, and THEN GET AN ATTORNEY? |

Did you list the dings in the bill of sale? If so then you definately don't have to worry about it. If your bill of sale states no warranty and the deal is done my guess is that you aren't liable. |

It's an "as is" sale unless you made a warranty of some sort to them. They may even try taking you to small claims court, but just bring your documents. If it's so "obvious" then they should have seen it before the buy so you shouldn't even have to argue you showed them the problem. |

No you aren't liable. The home belongs to them now. If they call and complain about anything else just tell them that you showed them everything before they made the offer to buy it. And good grief they looked at it 3 times. It isn't your fault that they chose to not look more carefully. There is only so much you can do as a seller. Your responsibility is over. It sounds like you did a good job on the paperwork also which stated that there was no warranty. |

It sounds like they do not have a leg to stand on. You are covered by the contract. They were aware of the damage, so it is not like they can say you deceived them. It sounds like they are trying to get money out of you for no reason. It is now their property, their problem. |

My guess is they bought it thinking "We can fix that, no problem... it'll give us negotiating power on the price as well".
Later they realized they are not skilled enough to do this, so they figure "Lets go after the seller". Like other said, if it is not a structural defect (that wasnt disclosed), they have nothing to stand on.
Sheetrock repair is a minor thing and IF they wanted it done they should have listed it on the bill of sale as "seller will repair". After the closing, any lawyer they use (if this was the case you would have been served already) will say "Well, can we prove that it is structural? And can we prove that he didnt show it to you?"
Once they answer "Well we went to the house 3 times and did notice it", the lawyer will say "umm you're scr3wed".
No warranty means just that, no warranty. If they want it repaired and insist on it, then simply tell them "no problem, here is my hourly rate and I want payment upfront for materials and 50% of my estimate of labor". See how long they still bug you :) |

i believe they are reliable for it they signed the papers its all them ....i mean can they prove it was there before they bought.....whos to say that they didnt to it moving furniture....its all on them hun no stress good luck |

It's done. It is their problem now. They should have also had an inspection done. Full disclosure is usually not required.... the only thing they can get you for is if they specifically asked you a question and you lied.
If they threaten to sue, tell them that they signed the papers, you have a copy and that you will seek damages from them for the cost of defending yourslef. They will probably back down. |

Buyer beware! Got to love these types. I had a buyer of my home complain because a rose bush did not grow.
Don't worry about it. I doubt they would spend money and get a lawyer for a little petty thing as sheet rock damage.
It would be cheaper to hire someone or fix it themselves. |

You are not liable to fix it. Once they paid, and the closing was done. You are no longer responsible. Caveat Emptor. The buyer should beware. They missed their opportunity to have you fix it prior to the closing. |

Direct them to the local home supply store, specifically the aisle that contains materials for sheetrock repair.
They are now the owners andthere was no warranty either expressed or implied by you.
I think they're barking because they know they can't bite you.
Unless it's a material defect in the home that would cause major structural failure, you're in the clear.
Even if it is a material defect, if it was disclosed in writing, you should be fine. |
