I cant be sure if you are in England but in Scotland, if you are married then the house is half yours whether you are on the deeds or not even if he bought the house before you were married, If he dies, the house will go automatically to you as his next of kin.
If he has any children they would be entitled to a claim on his moveable estate but this doesnt mean that they would be able to make you sell the house. |

you do not automatically get the house based on your marriage because he acquired the house prior to that event. you can either with a will or addition of your name on the deed. the two of you can also refinance the mortgage (if there is one) under both your names. |

It depends where you live, but you do have a risk of losing your home. It's time to sit down and go through what you need from him if - heaven forbid- anything ever happened to him.
Where i live, people that are married automatically are entitled to shared property...so, I'm not sure. |

Unless your husband include you in a trust or a will the house will go into probate and will be probated by the laws of your state.
In communty property states what ever you accumulate together automatically becomes 50% yours and 50% his.
In other states that are not community propery states how you hold title determines how the property will be divided and who shares what and with whom.
I am rather surprised that you are asking questions about this situation now, since one of the top priorities in a relationship is finance.
You should have inquired about this arrangement before you married so you knew where you stood and understood other financial matters of the family.
The other is religion and what will be taught in the house hold and to potential children.
Since these things apparently were not discussed prior to marriage you should make this a matter of great concern and find out where you stand financally in this marriage.
What you are expected to contribute, banking and savings should be discussed as well as the vehicle in which you want to accomplish your financial goals.

The easiest way is for him to do a quit-claim deed adding you to the property. You won't be on the loan but you will have ownership rights without having to deal with a big hassel. This has to be done voluntarily by him & it needs to be recorded at the Register of Deeds office in the County the home is in. In my state it is a 2 page document (any real estate atty. or title company can prepare it for you) & it costs $13.00 to record. |

In Texas if there is no will I am told that any current spouse would inherent half of the estate and any children that the deceased has inherits the other half as a group.
If your husband has never had any children (this would include any illegitimate children) then you would get everything.
This may not be correct and it certainly may not be correct in your state and you may not know about all of his children.
There should be a will. You should try and get him to add you to the deed.
Maybe an easier thing would be to say, "Lets move and buy a new home together!". That would put you on the deed. |

You should unless he has willed it to someone else like a child or another family member. Does he have written will? This is something you need to talk to your husband about! You both should have wills to protect each other. |

Not necessarily. You really need the assistance of an attorney if he intends to leave the house to you. The attorney can advise the best way to achieve his intentions. The last thing you want is to get into a battle with his children over the estate. |
