I am moving out of my rental house in a week and i cant get ahold of my landlord. She seems to be avoiding me.
So my lease is up Oct 31 and she stopped by in May to tell me she was putting the house up for sale, so she could get a head start on selling it by the time i moved out since the market took about months to sell. Well since then the market has dropped and nothing is selling. So I have been calling her number with no answer and never a response to messages i leave. I called her work only to find she has left. I can not get ahold of them. What should i do? I want my deposit back, as there is nothing wrong to the house. I have no idea what to do from here.I need to protect myself since i can not walk the house with them before i go. What do i do with the keys? If you have any idea please let me know! thanks!

Well i have more information that i have found out and decisions that i have made. The only address she gave me is a PO box and her cell number. I found out today that an address i found in an online search in another county under her name is under foreclosure. So after some talk with people at work they recommended that i stop payment on the last check i wrote her (equal to the security deposit). I sent her a certified letter stating what i had done and due to lack of response from her and information i found out about her that i have stopped payment in lieu of the secuirty and to contact me for further information since i can get through to her. I also talked to the realtor and he has not been able to reach her and she has left her last job. so all seem very suspecious and hopefully i made the right decision.

I had an insane landlord once, so here is what I did when I moved out. I took a disposable camera and a newspaper from the day before I moved out and took pictures of every room with the newspaper in it. The newspaper showed that there was no damage or problems. Another thing you can do is make a detailed inventory list of everything (fixtures, lighting, appliances, etc...). Note any and all damages, no matter how minor it seems.

As far as the keys go, just leave them in a safe place in the house and leave a message for the landlord at work explaining where they are in the house. Or drop them off at their office or even leave them in the mailbox, but only as a last resort.

Send a certified letter with the keys enclosed. Also take pictures of the entire house before leaving. If you don't hear from the landlord in a month then sue her in small claims court. Above all else protect yourself. Take those pictures.

Send her a registered letter. ANd make sure that you ask for a receipt and SAVE it in case she tries to sue you for any reason. This way you will know that she got the letter and also have proof that she got the letter. Id do it right away , if you only have a week!!

did you rent through an agency? If so go to the agency to get your money back.
If you rented privately, send her letters, phone her more at times when you'll know she'll be in i.e. 9pm.
Or if you know where she lives go to her house

I don't know what country you live in, but if it is the USA send a registered letter to her last known address. If she is no longer there but left a forwarding address with the post office I think she'll get it. If she doesn't get it you will have a receipt back as undeliverable.
Otherwise you should consult a lawyer.

She probably doesnt have the money or want to pay you your deposit. Send certified letter, giving her a date to refund your deposit, then file a complaint with your state. Be sure to keep all your documentation.

If she will not return your calls or anything and you have a lease you could go to court. Either call or go by and see what needs to be done. I am not sure what to do with the keys but I guess you could keep them until she gets a hold of you or you go to court and explain the situation. You could also go to the reality office where the house is being sold to see if they can help you find her.

Did your lease require a 30 day written notice? If so, did you send it to her in writing and keep a copy for yourself. Once you move, I'd take pictures with a camera that has a date stamp, that way she cannot claim damage that is not there. If you've signed a lease stating the end of your term she cannot keep you there, unless she required a notice and it was not given. If you just tried to notify her verbally, then be careful because she may come back and say that you never gave notice. A landlord has up to 30 days before they have to send back your deposit. Your notice should include your forwarding address as well. Do you know where she lives? I'd personally take the keys over myself. If she is not home, then leave them in her mailbox. Just make sure you document everything you do from here on out. If you make a call with no response, make note of it. Anything that happens, make note of it. It's a shame that she is being like this towards you. However it may just be a case that she is really stressed with trying to sell the house in this market and with her day to day activities she may be super busy. Maybe it's just slipped her mind that you are leaving. I hope that this all gets resolved for you. Good luck!

Send your landlord a registered letter. Take pictures of the house before your final departure. Keep dates or proof of phone calls made to her. Save all records (rent receipts, cancelled check,etc) and prepare to go to small claims court.
Notify your landlord of your concerns and intent to go to court.

Certified, registered letter. Document dates times and numbers that you have used for telephone contacts. If she did not give you anything in writing about vacating document your verbal contract. Before you leave take photos of all the areas showing the move out condition (use a current newspaper in the corner to document the date that you have vacated the property.) Hang on to the keys and in your certified letter let her know that she can pick up the keys at the place of your choosing and convenience. Do not leave them on the property, under a mat, etc... In your letter let her know that you are fully anticipating a full refund of deposit and give her the timeline specified in your lease or by state statute for the receipt of funds. If you have not received by then - tenant landlord court, small claims or realtors board for satisfaction.

Take pictures before you leave. If she has a mailing address, request your deposit by mail and tell her where she can contact you to get the keys. If you still get no response, go through the small claims court, it is very cheap and you dont need a lawyer.
