I would suggest asking your (or his) solicitor to draw up a Trust Deed - essentially just a document setting out how the house should be divided should you separate. Dividing property when unmarried couples separate is, I gather, not always very clear or straightforward. It may seem like a horrible thing to put down in writing (I joked with my girlfriend - now my wife - that we were signing a pre-nup!) but owning property together is a major commitment and the Trust Deed protects you both equally. |

How can he get a mortgage alone? As long as your name is on the property, you have rights to the house. The mortgage company can't take his portion of the house. . .so I doubt if they will give him a mortgage without you being liable too. |

Well i deal with this kinda stuff at work..
If you are just bf and gf then the only way you will be entitled to half the house is if you show to the Court that you have made contributions to the mortgage.. so if you're going to do it that way.. i would advise you to keep some kind of paperwork showing this.

Presuming you two are going 50/50 on the payments .....
Meaning you're not playing the princess who collects and runs ...
Yeah, you get half.
But no matter how in love you are now, please make sure you keep your paperwork up to date. If things turn sour, you're gonna have a hard time proving you have equity otherwise. |

Morally, if you going 50/50 with everything from to start to finish - meaning the deposits, fees and paying the mortgage, then yes you are entitled to half. |

If your name is on the deeds then you are an owner of the house.
So you would get half of his house but he wouldnt be entitled to any of yours.
P.S. I agree, maybe this isnt the right guy for you if your planning on how to take his money! |

yes, but the boyfriend is DUMB to do this.
If you break up, you own half the house. If he wants to sell, etc, he will need to work something out with you - like buy you out.

I'm not sure how the lender will allow you to be on the deed if you are not also on the loan.

If that boy is so stupid to put you on the deed without being on the mortgage then I pity him. He is giving you full ownership rights and absolutely no responsibilities. Once your name is on the deed you can walk out the door and come back 20 years later demanding your half. |

Really, I cannot believe this is your question. Are you going to put his name on your deed? Seems like that is the way it should work.
If you don't have some sort legally binding agreement on how this is going to work, you are going to pay THOUSANDS of dollars to an attorney to undo this. There are regularly questions on here about division of property outside of a marriage, so for both of your sakes, just pay an attorney to draft an agreement about disposition of the house when you break up. |
