SunOfAJava | I am not going to pay then rent. What will happen? |
I am moving out at then end of the month but landlord wants me to pay the next two months rent.
I refuse to pay this, what can they do ? (you cant go to prison for not paying the rent can you ?) Additional Details I already bought a house and have 3 credit cards which I hate to use. So I am not worried about bad credit because this will not affect me. I have my reasons for not wanting to pay and now just want to go to war with my landlord agency. |

they will get a judgment against you an place a lien on your new house, your credit will be ding and hopefully in the future you do not need to pull your credit to buy a car, seconded home, etc, also it will come up if a new employer runs a back ground check |

Depends on what agreement you agreed to when you started the tenancy. If you are obliged to give two months notice of moving out, and did not give it, then the landlord is entitled to two months more rent in lieu of notice. It is unlikely that you would be arrested and jailed but a case in the civil court could leave you out of pocket and forced to pay more than the rent owing. |

Escaping rent after you purchase a house can serve to bite you in the backside. The landlord will likely sue you which would result in a judgment against you which will foul your future credit. You may be happy with your present credit cards but the interest rates on those cards are only set for a year and when the cc companies run your credit in the future they will either be revoked or the interest will rise. And the landlord could turn the judgments against you into liens on your house making you unable to sell your house without first paying off the judgment. And there is more ... depending upon where you live, the judgment can accrue interest until it is paid off. The bottom line is if you don't pay them now, you will pay them later and it could be a great deal more.
It isn't up to the landlord to prove notice has been given, that is your responsibility and a claim of "lost in the mail" isn't viable. |

You work? If taken to to court and LL gets a judgment he can dip right into your checking/savings account and take the money or garnish your wages. |

So, you have a contract which you presumably signed. You want to break the terms and you want to go to war with the landlord's agency. You propose lying about giving notice.
You need to explain or you are going to simply look like the guilty party. Your potential approach seems dishonourable.
Is it the Landlord you have a beef with or the Agency?
Why don't you rephrase your question giving some specific info on the problem. You might then get a useful answer. |

no you cant go to prison, but he/she can hire baliffs with a court order to sieze anything of proportional value. (if your in britain). if you've paid 2 months rent from the first day you recieved the house rental agreement then i dont see why your landlord is demanding a further 2 months rent after you leave. he/she has the legal right to keep your deposit anyway if you leave before the lease is up for renewal. strip the house bare of anything you put in it including wallpaper and carpet, if you installed it. then stop all direct debits from your bank to the landlord. if they refuse to do it then set up a new account with another bank after withdrawing all your money and getting your wages paid into that account. |

The worst your landlord can do is to file a claim against you, win the case, send the claim to a collection agency and ruin your credit for a very long time. If you have credit cards the card companies will be able to jack your rates becasue of that collection effort. And if you need to get a student loan, buy a car on credit or even buy a house - good luck. And guess what, the only way out of that is to pay the claim off (with interest & collection costs) or bankrupt yourself. Other than all that you have practically nothing to worry about. |

Sorry, a lease is a legally binding contract. YOU broke it, not the landlord. By law, you MUST pay for the remaining 2 months. If you pay it before moving, then you'll never have a problem with it and neither will your landlord, but if you continue having an attitude like this, your credit rating WILL go down, and he CAN take you to court over this and you WILL lose. Naive boy. |

If your tenancy agreement is that you only have to give 2 weeks notice minimum, then you're sweet
If your agreement says something else e.g. 3 months notice, 12 month lease, then you're screwed :) |

it would go to court probably but oyu need to check your tennency agreement!

You could be mentioned on various property networking websites and may find it hard to rent a property again.
Serves you right. Why should your landlord be out of pocket. |

Yes they can take your money from your bank account once a judgment has been issued...and yes they can also put a lien on your new home. You broke a contract and on top of that screwed the landlord...don't for a minute think that there are no consequences to your actions. BTW..you sound like a terrorist. |

Your landlord/agent should take you to the small claims court with an attitude like that. I bet you weren't so far up your own backside and cocky when you wanted to move into the place. No one forced you to do that either. |

If i where you i would pay or he could come into your house/flat and make you pay more. He could say this is broken or that needs replacing he could be real arsy about it. |

they can take you to the small claims court.
what does it say in your contract? have you given sufficient notice? If you have to give 2 months notice (tho its normally a month) and you are moving out sooner, then yes he has the right to want payment for the 2 months?
if there is no notice period in the contract (silly landlord) then tuff s**t, you can go when ever your want.
did you pay a deposit? I assume you are not getting it back if you did. |

Not that I know of and they can't throw you out because your leaving anyway. They could sue you but it would depend on how vindictive they are I suppose and what valid reason you have for refusing to pay. |

You can't go to prison or anywhere else for non payment. If your landlord holds a deposit you will lose that but thats about it. |
