I am not sure, but since you purchased the home in that location, you are likely responsible for the past rent. However, if the fact that there was past due rent was not indicated anywhere on the paperwork and it should have been, you may be entitled to attempt to get that rent from the previous owner. Check your legal documents, and if you purchased through a Realtor, you should be able to ask them. |

I don't know what planet that landlord is from but in the US you can not be held responsible for someone else's debt unless you agree in writing to such obligation. I was glad you didnt say it was in Roswell NM

Probably, since you assumed the lot lease -- unless the landlord waived it in writing. |

I'm not in your city, but common sense would tell you that it you purchase real or personal property that is housed on others properties, you need to get a title search and they chk with the property owners to see if monies are owed 1st. b4 buying.
To allow you to remove the trailer from the lot would relinquish the owners right to lien sale. |

Read your purchase contract very carefully. If there's language in it which says you're assuming debts and liens from the previous owner, then yes, you're responsible for paying the back rent.
If you used a real estate agent to buy the mobile home, he should have discussed this with you and made sure you understood that there were unpaid debts involved. He may know the way to attach the previous owner's wages or bank accounts.
You may be spending time and money in court if you decide to pursue this. Weigh the $$ of back rent involved with the costs of hiring a lawyer and possibly losing. |

If I were you, I would get on the phone tomorrow and call lawyers in your area. Don't allow them to brush you off if you can't pay, ask them for a name of someone who can (someone who handles contract/tort law and/or real estate law I would guess). There are legal services available for those who have an inability to pay.
I'm not a lawyer, but I would think that if you didn't live there on the property or the title of the mobile home was not in your name, the land owner can not expect you to pay for those months that the residence was not in your possession and/or use.
Forever ago, my ex and I bought a mobile home on a rented lot but I don't remember what we were expected to pay and what we weren't.
Hope I was helpful. |
