Joanne W | I brought a house with my ex 8 years ago and only lived there for 6 months, my name is still on the mortgage. |
what shall i do? what am i entitled to |

Until your ex refinances the mortgage company will not remove you from being responsible for the mortgage. You may have a settlement in a divorce that says you are no longer responsible but the mortgage company will not agree with that.
I don't know that you are entitled to anything. Your divorce settlement would line all that out. If you are not divorced then you may still have some ownership in the house. |

what do you mean, what are you entitled to? Leaving your name on a mortgage was foolish--or do you mean on the title? If the current owner defaults, it will be your name and credit going down the tubes, too. |

All this depends a lot on state law but here's some more things to consider:
Are you on the Title (the deed) and the mortgage or just the mortgage?
If you are on Title, how are you listed there? Joint tenants, tenants in common, etc.?
You should contact a reputable lawyer in your area to get detailed answers to this question. |

How much did you contribute to the purchase price? if anything.
if you paid half for the house, you are entitled to a 50% of the proceeds when its sold. It really doesnt matter how long you lived there.
You should try and come to some agreement about the mortgage repayments for your own credit rating protection, if she defaults on payments it will affect your rating. |

you are still entitled to be paying half the mortgage if your name is still on it. You would be best consulting a lawyer to see what steps you can take to get your name off the mortgage. You would have to prove you had been contributing to the running costs of the house to be entitled to any money and you would most likely not be entitled to a share of the house unless you had put money down as a deposit. Again, you would have to prove this. |

it all depends on what deposit you put down in the first place and whether you have been paying money towards this mortgage. The less % you pay towards a mortgage payment the less % of equity you will get when the house is sold or when you are taken off of the mortgage.
Why weren't you deleted from the mortgage deed when you separated?? Did you come to some agreement at the time??
More information is possibly needed for this.... its a strange one... and you possibly won't get as much money as you possibly think, unless there is a prior arrangement. |

But is your name on the deed? If no, your signature on the mortgage is only done for the spouse to acknowledge the lien on a primary residence (homestead state). If your on the deed then you have certain equity that you may be entitled to and you consult with an attorney before signing any releases or quit claim deeds.
Hope it helps |
