Yes, and is known as "Deed In Lieu of Foreclosure". Once you sign the papers the bank immediately takes possession and, in most cases, demand you to move immediately.

If you need time to move allow the law to work in your favor. The bank has required, under law, procedures to follow with various notices of their intent. The first contact will be called "Notice of Default" and will be issued via "Certified/Registered" mail after you miss your second, maybe third, payment. Make sure, EXTREMELY important, you answer within the stated time limit in this notice. Remember the bank is not your "enemy" and they would love to help but cannot unless you give them the courtesy of a response, ANY response.

Keep in mind, these procedures vary with each state as to time frames, i.e., in Georgia it takes approximately 6 months. Notices are to allow you to possibly work with the bank in payment of your mortgage because they do not want your home. Most lenders and banks will offer some sort of payment program initially to help.

Time on your part will allow you to try and sell or establish other "means" of income to "get back on track".

A bank won't repossess, but rather foreclose on you once you are behind on your payments.
Why don't your try selling on leasing your house? That would prevent foreclosure and prevent devasting credit consequences.

If you have any equity in the home, SELL it. Even if you walk away with $200 cash out of the transaction it is far better than having the bank take it back. Talk to a real estate agent with experience with this type of situation and see what they can do....and yes, call your mortgage company now!!! If they will delay filing a notice of default long enough to allow you to sell the home on the open market and walk away, it's better for them and it's better for you.

There are people looking to rent a room all the time. Why not let your rooms out that way you get to pay the mortgage, live on the property for free and and make extra money/profit.

Talk to the bank - and possibly to the Citizens' Advice Bureau to ensure you understand the consequences, which can be different when you ask the bank to repossess, not least in terms of (not) qualifying for housing from your local council.

Yes- but this is not without consequences. Your credit will be affected, and you might still owe them money.

yes you can and they will but your best bet to to try and find a buyer, you might not make any money but your credit will stay in good standing. Also if you dont want to move just call them up a tell them whats going on some will defer your payments till your back on your feet, or you can try to refinace at a lower rate before you get to far behind. Yes but it's not that simple because they incurr huge costs in doing so (legal fees etc) so it's not just a case of hand it back and thats it. You'll have to go bankrupt, you can't just hand it back and carry on as normal so you're better off just trying to pay it otherwise it could make things much worse.

I would suggest you talk to a real estate investor. You know, the ones in the paper "we buy houses" or "we buy forclosures". Talk to them, tell them your situation, and 9 times out of ten they will work a deal out with you. Maybe you can assign you mortgage over to them, and they give you some money to go on your way. I dont know what clauses you have in your mortgage, or what state you are in. But there are alot of ways to get out of a house without forclosure or messing up your credit.

Have you tried to refinance your house? Have you kept up with the payments so that your credit will allow you to do so? If you do not pay then eventually the bank will take your house and this will ruin your credit for 7 years! I work in the mortgage business, right now the market is crazy. If you end up renting a house then you are just throwing away your money. Call 1-888-500-0000 if you are interested in refinancing. Ask for Aaron, tell him Jenny sent you. He is great!
