I closed on a home this evening. Both myself and the seller signed the closing paperwork. The seller told us that he does not want our personal belongings to be moved in until he gets his check from the mortgage company. Can he hold us up from moving in even if all the paperwork has already been signed and the loan has been closed? It could take two days for him to receive his check and we have to be out of our rent house tomorrow. Additional Details In my contract, it states that: "The seller shall deliver to buyer possession of the property in it's present or required condition, ordinarily wear and tear excepted, upon closing and funding." So I guess that means that he can't tell me I can't move in until he gets his check which will be tomorrow. |

Unless you agreed to allow him to stay there. You are now the homeowner. Actually if he is still there he should be paying you rent. Think about it, the property is now in your name you are legally responsible for it. So move in and enjoy. He should have walked away with his check when you closed? |

Your situation sounds a little strange to me. When I closed on my home, the home became mine and we received the keys at the closing and started moving in that same day. Once you've closed the seller no longer has any say. |

Hi, it's kinda a LOL thing. Who gave you the keys? I gerss the seller did. That's possession, you are in the care, custody and controll of the property until he get's the money. No one in there? Move in! Did the seller put this in writing and did you agree? Probably not. In real estate in all states, only those terms in writing in the contract dictate performance of the parties and the seller handing over the keys is the greatest indication that possession has been given. Ask the seller, if you even see him, if he wants to pay rent at $100.00 a day...just move in! By the time the seller crows about it, funds will be disbursed! Good Luck, Bill |

Until the transaction records at your county office, it is technically not your property. In my neck of the woods, typically the transaction closes the following business day. |

The date of occupancy is in your paperwork. It's not when the seller gets the money, it's when the title company gets funds wired from your lender. Funds should be at title company tomorrow morning or by noon at the latest - if not, get your LO on the horn! As soon as title gets the money, you get the keys. |

When the deed records, the property is yours. Possession is determined in your purchase contract. Normally it is the day the deed records, but sometimes it can be after in cases when the seller needs the money to move. Check with your agent, they can tell you when you will get the keys...since they are the ones who usually give them to you. |

Check your paperwork thoroughly. It should have a time and date your possession of the home begins. That's when it's yours. Paperwork can be filed legally with the county within a certain number of days....just like buying a car and getting it registered in your name. it's still yours when you buy it. Usually home possession is at 5 p.m. on the day escrow closes. However, it also has spaces in there that if you signed and agreed to it, he may stay there for a few days. After that, he pays you per diem or so much per day.
Check your paperwork. Your agent or REALTOR should have advised and explained this to you.. |
