I considered moving in an apt but never signed a lease or moved in-can the landlord take me to court or sue me
The landlord keeps calling saying he will take me to court and win but I never signed a thing or moved in. Is he just trying to scare me into paying money?

If there is no legal contract i dont think he can take you to court for considering renting from him

If you never signed a lease, this landlord is simply trying to cheat you out of money. Ignore him, UNLESS you made a verbal "contract." If you said anything like "yes, I will rent this apartment" that can be considered a "verbal contract" and is usually binding by law in most states. And it is your word against his, so you never know what could happen if you did say that and if this landlord did take you to court.
But unless you made a verbal contract, tell him to suck wind. He can not do anything to you, and do not let him bluff you.

I don't think so - especially if you never moved in or paid him any money. Call a lawyer, get a confirmation on this (or not) and tell him that your attorney says you should sue for harassment - that should send him running!!

Pay no attention to him, you have no obligation without a signed lease

sandy
He can't do anything but ask the police to talk to you. If you pay in checks-or have proof of payment- he'll never be able to prove anything.

Lol- I know because the same thing happened to me. I was living in an apt, and my friend was on the lease and I wasn't. So, I wasn't responsible for anything.

He cant win with no contract. Hes a douchebag and needs the money. Tell him your filing harassment charges.

Rock_N_Roll_Chicky
as long as you did not sign anything you have no deal .. however, if you had a record conservation and said yes maybe

You can have a verbal agreement to move in that will be upheld in court. Make sure you know what you said to the landlord, otherwise he can take you to court.

no he can't, not if you did not sign anything

If you never signed a lease, then you don't have to stay for any certain time.

Did you pay rent? If not, you never really rented an apartment, and if you never signed any rental agreement, then you owe him nothing.

The guy is a jerk.

Some people go on a verbal agreement, if you say, yes I will take it, and he takes it off the market, then maybe if he really wanted to, he could take you to court for 1 months rent.

But just considering it, means nothing, everyone considers lots of apartments before deciding.

jmiller
No, as long as you didn't sign anything, or move anything in.

If you didn't sign anything, you have NO obligation to this moron! Be thankful that you discovered that he's a raving lunatic before you signed a lease! Can you imagine living with that maniac as a landlord??

The next time this halfwit calls, tell him that if he contacts you in any way again that you will file harassment charges with the police. If he does call, then call the cops!

Apple had a bad week.
No, they can't take you to court if you didn't sign anything. Next time they call you and start your crap tell them that you are going to take them to court for harassment. If that doesn't get them to leave you alone, then do it.

nsg_2006
If you didn't sign a lease or some for of contract, and didn't move in, he has no case. He is just threatening you. Tell him if he keeps harassing you, you will take HIM to court. Good luck!

J-Real
no, you only considered moving in, if you never signed anything his case will be dismissed because he has no proof that you have even showed interest in the apartment

If you didn't provide him with first and last months rent, didn't sign a lease, didn't receive a key to the place and didn't move in...the landlord is pulling your chain, or he has no idea how to be a landlord.

If you have done none of these things then the next time he calls tell him that you will report him for harrassing you if he doesn't stop calling you. He has no grounds to sue if such is the case and I think you can relax.

He likely hasn't had much interest in his property and he's hanging on to the one chance he may have to rent it out. However, he isn't doing himself any favors by coming off like a hostile desperate person.

Take care and good luck

No! If you didn't sign anything he doesn't have a case. Even if you said you wanted it, you still have the right to change your mind if you didn't sign anything.

If you never signed an agreement or paid any money down, then I don't think they can sue you.

dt
Tell him you have the email address of everyone in the local govt and if he doesnt stop you are going to tell everyone what a jerk he is.

jenks1545
nope he legally cant doing anything to you unless you sign a lease saying that you would pay so much for the place. so tell him to take you to court it will be his loss.

no nickname
If you never signed a lease then ignore that landlord.

e_deckwa
He is just trying to scare you. If you didn't sign anything then you are not obligated to him. Although if you gave him money to hold the apt. for you then he doesn't have to give it back to you.
