You are 19 days late--that is a WHILE. You made promises and you broke them, and you are late, generally after the 4th or 5th. You need to read the notice carefully, then decide to pay the rent you owe, plus late penalties, and do so quickly to avoid eviction, or to decide to move out, and still be liable for the rent for November. The LL's 4 day notice is the first step in eviction. |

When you knew you where going to be late did you call them, explain the situation and let them know when you could pay? Did you attempt to make even a partial payment, like half? They have to pay their bills on time and some of those bills come from receiving rent. Without communication it might have looked like you where scamming them and planning to stick them for the rent. Always communicate when you have a problem, then you have a chance or working out an equitable solution |

It's not an eviction notice. It is a notice to move out or pay. This is the first step in the eviction process.
Being just 1 day late is grounds for the owner to give you the 4 day notice. The way to stop it, is to pay the rent. |

It is quite legal. Many landlords will begin the eviction process after you only 2-3 days late. Pay the rent before the 4 days are up or face eviction. |

If the due date for the rent is the first and the first does not fall on a weekend or a holiday you can be served your "pay or quit notice " on the very next business day. There are very specific legal reasons that your landlord might not have been willing to accept partial payment for the rent but you should have at least kept him informed as to how much of the rent that you did have, when you would have all of it , and how you intended to be able to pay the next months rent on time. Your Landlord wants to limit their loss as much as possible It will be very difficult to get you out of his place and rent the unit before another month's rent is lost. |

It depends on the lease or rental agreement. Read the agreement you signed and find out if the landlord can evict you with 4-day notice. It looks like the term was that when you are 15 days late in rent, the landlord has the right to evict the renter with 4 or 5 days notice. Do read the agreement but if the landlord is right, show willingness to pay and make an arragement to pay even a small amount until you catch up so that you won't be evicted.

That depends on what state you live in. I would suggest calling a lawyers office and asking for legal advice. I could have sworn that they are required to give a 30 day notice though. |

are you sure what you got was an eviction notice? usually if you pay late, landlord will issue something called "notice to pay or quit". Basically its letting you know that you get this grace period of time to pay up or be prepared to move out.
If at the end of the grace period you havent paid the rent in full (including late fees), then landlord can take action to have you evicted legally through the court system.
from what you described, I would say your 5 day eviction notice was more likely a 5 day to pay or quit. Each state has its laws on length of time for notice of eviction, but usually its 30 days minimum.
I would suggest you pay the rent, or face more difficulties in renting apartments in the future based on your poor payment history. |

Well, you thought wrong. Many states allow the landlord to serve a notice to Pay or Quit on the day AFTER rent was due. Your landlord gave you 19 days before doing so, which is more than generous.
To all the posters who insist that a landlord must give a 30 day notice - you are wrong. When a tenant does not pay the rent, a landlord is only required to give between 3-15 days notice depending on the state. |
