I have a judgment against former tenants for $5600- how can I collect on this?
I've tried to garnish their wages (he is a 1099) and she works part-time; and garnish bank accounts, but she closed hers, and I have no idea where he banks. I have both or their SS#'s but still don't know what to do...
                     
 




Landlord
Employers with 1099 still are legally required to pay the garnishment. The status has no effect at all on it.

Personally I just use collection agencies, they charge 15%, but you are allowed to tack on 10% interest anyway, so in the end you loose very little by letting them do the work.

You have wasted your time... those kinds of people will just move on if you start closing in and all they have to do is move out of the court's jurisdiction and they can stand at the county line and thumb their noses at you.

you can take out a lien on any of their current property or seize their bank accounts. Unfortunately its a pain in the butt and difficult to do. I would get a collection agency on them, it makes their life hell especially if you have their current phone number or address

You can continue to hold the judgment and eventually you might be able to collect. I fail to see why a 1099 employee would not be garnished as anyone else if your know the employer, get a court order to do the garnishment. Take or have it delivered to the place of employment. The employer is required to deduct this amount from any employer 1099 or W-2 employee.

You may sell this judgment for a discount. There are some collection agencies that will purchase this judgment from you for about 75% of the face value or somewhere there about. You may negotiate this buyout.

These agencies will pay you cash. You then sign the judgment over to them, they will take the responsibility of collection.

You may hire a collection agency to do the collection in your behalf. They will charge you a fee for their service. This fee should be somewhere between 10%-15% but then you may negotiate this fee.

Judgment is the easy part collection is the hard, do they have assets to attach besides the bank account? if not then they maybe are what the law calls judgment proof, to wit you will just have to keep the judgment active and hope in the future they buy an asset like a house or inherit monies

Do a major credit check on the next tenants.. you have found out that it is worth it. Call their previous landlords, and employers. You would be surprised how many people do not do that. Good luck.

I think it's possible that you should reconsider your status as a landlord. You can't let yourself get screwed like this- if they don't pay the rent you get them out of there at fifteen days and find new tenants. No one can screw you for $5600- unless you LET them. You need to move on and focus on preventing damage not fixing damage. You won't get money out of an old tenant, period.

The courts don't just garnish right away...the tenants have to be given reasonable time to pay the debt back, and they also have a right to appeal, and they have a set amount of time to file paperwork to appeal the decision. It's very hard to get monies won in a judgement case in a timely manner unless the tenant willingly pays you.

There is an old adage "Getting a judgment and getting money are two different things".

Unfortunately, you may be out of luck for the time being. However, these people will be unable to purchase property or complete many other major transactions until the judgment is released, so you will likely get your money someday.


MIND THE GAP
Hire a private detective to find their bank accounts. These people can find out that information. They have an attorney help you get what is owed you.
