As for entering your basement when you're not at home, the landlord is supposed to give a MINIMUM of 72 hours written notice of "Intent to enter premises". To do anything else would be a violation of the "Landlord Tenant Act" in your area. If you really have concerns about it you can pick up or have mailed to you a copy of the LTA from your State or County's Housing Authority. As for his harrassment of you for rent being paid so long as your are paying your rent in a timely manner he has no right to so even if you were to be paying late his only legal right is to begin the eviction process, 3 10 and 20 day notices, finally court involvment and sheriff's removing you from the property.
With this in mind, you have a very real possibilty of staying there rent-free if his behaviour continues. Following up with a lawsuit in your favor he could be odered to give your either monetary compensation, housing compensation ('X' months rent at no charge to you). not too mention having to walk a very thin line with you following all of that. Since his action could be construed as retaliatory, therfore further punishable as prescribed be law. |

talk to a lawyer and then the police, chances are you can get a restraining order as he is acting illegally. Also i would subtract your lawyers fees from the rent monies as his actions have caused you monetary loss and distress, he wouldnt dare contest it. |

Contact your local consumer affairs office. Look in the beginning of the phone book for number or go to your local town hall and ask the clerk at the desk who you can report your landlord to. Your landlord must give 24 hour notice to you if he wants to enter your apartment and he needs to give a reason why he is entering. If he calls and leaves nasty messages on your phone save all messages and go to the police to report him for harrassment. Start a log about the harrassment. If you have to pay the electricity have it put into your name. Call the electric company and say you need the bill in your name for your apartment because he makes you pay it but does not show you the bill. Try to get copies of the bill. Have a notebook on hand for your harrassment log. If something happens write down that day's date, time, if you have any witnesses with you such as your children saw or heard what happened, and the write down what the harrassment is at that time (coming over unannounced, calling and harrassing for rent). |

Ok, I am a site manager and I think I can help you. First find out what your lease states about rent, then find out if you can discuss with him that you have no plans on being late and to please stop harrassing you. Second, entering the house, IF he gives you notice that he will be entering the house and gives you the reason why. Sometimes the laws are on the internet concerning you state dealing with Landlord Tenant issues. But if he is going through your personal belongs that is a major no no! I agree that a camera would be a good idea! Just because he is a landlord he still has to show you respect! |
