Yes, you absolutely have to give him a key. You want to, it is very expensive to have a lock smith come and break in to make new keys, and that is exactly what he will do.
It is illegal for you to lock a property owner out of their property. You have no right to do that, and are actually creating a hazard.
Personally I would evict you ASAP. |

Laws are different depending on where you live. Usually it's 24 hours notice. In CA I believe they can only enter with permission, unless it's an emergency. |

The landlord has every right to a key under the fact that based upon an emergency with the unit the landlord has the legal right to immediate access to preserve the unit period, so the landlord's options are change the locks and charge you, or even the eviction which the courts would up hold
now is it legal to enter without reasonable notice? no, is your recourse to change the locks? no, you can press trespassing compliant either criminal or civil |

I would seriously consider finding a new place. There's no reason for the landlord to always be going into your place of residence, unless he has a reason to. If he has no proof, beyond a reasonable doubt, that there's something going on, then he can't gain entry into your place. If your landlord cannot communicate with you why he feels the need to go into your place all the time, then you need to confront him and get to the bottom of it. Maybe he's nuts!!
I'd look into this with a bureau or some kind of organization out there that provides resources on the Tenant's Rights....something of that nature.....
Don't think for a moment that just because you're living under 'his' roof, building, or because he's the 'landlord' and you're just a 'tenant', that he can get away with this.
IF there is a chance that nothing can be done to stop him - then maybe it's time you move on and find a safe and secure place to live, without the worry that a landlord is invading your space, and possibly poking tiny holes in the walls and watching your every move. Sheesh..this creep could be one of those 'compulsive, obsessive' people.....Eeegads...that gives me the creeps just thinking about that!

It is usually the law to give 24 hour written notice unless there is an emergency. It is also in most leases that you cannot change locks without giving him a key.
What excuses does he give? There are some creative things I might do depending on certain circumstances.
Are you allowed pets? Does he have a pattern? Is he married and are you female? Are you ever home when he does this? |

Ohhhh my god, that's so weird. Whenever I've had to go in it's because my tenant is aware and has given me an OK.
I wouldn't give him the key. Also, I think he's taken it too far by answering your phone. |

I think its a bit of a privacy invasion. Yes, notice would be realistic and as for answering the phone... don't let them do that. No don't give them a key - you can't trust 'em. |

Not all states require the landlord to notify you of his intent to enter the home. Most, if not all, states require, by law, for the landlord to have a key in case of an emergency. Failure to provide a key to the landlord will likely result in an eviction for breach of contract/violation of state law. |

sounds really creapy! yeah, you should have 24 hour notice for the landlord to come in unless its an emergancy but even then they should contact you first. if you rent through an agent, inform then what the landlord is doing. i would consider moving as your privacy keeps being invaded, especially if he is answering your phone! to me my phone is just as private as what i do behind a closed door! if in doubt, just get out! |

your landlord has violated your rights. He may own the rental but just can not could in without you being there. Do not give him a key and for your protection you need to call the police to keep a paper trail on this just in case this ends up in court in case you have to move out. I would be outraged. After all you have rights too. |

That is bull crap. He does have a right to come in and you are correct about the 24 hour notice and he does not have a right to the key. A lot of apt buildings may have something that you sign which allows them to come in once a month with a notice to inspect. Also they have keys so that maintenance can get in. But they do not come in with out the proper notice or your request to fix something. Your landlord has no right to harass you like that. |

you should call the Salvation Army, they will get you in touch with the landlord/tenant advocates. It is highly illegal what he is doing, but he does have to have a key. You can set up a camcorder, and record the premises. If he enters your home, and you did not know, you can call the police and he can be prosecuted. It is called TRESPASSING |

This is illegal and should be reported to the police. You can file a police report on him because this is a violation of the lease unless it is an emergency you should be given written notice 24 hours prior. What is he doing in your home? I would suggest moving also. |
