She broke the lease so normal eviction proceedings would be legal. I would recommend a $250.00 additional deposit for the pet. I have 2 pet rats and this is the option my landlord gave us. I gladly paid. If you do this be sure to amend the rental lease to reflect the change. |

You can demand she get rid of the cat, provided the no pets clause is clearly specified in the lease. She signed the lease knowing full well she was deceiving you. If she bails on you, you can keep the security deposit. Unfortunately, you may be restricted from re-renting the unit until such time as formal eviction procedures have run their course.
You could also demand she vacate based on lying ont he application. |

She has violated the lease, so the ball is in your court. You could ask her to remove the cat and continue the lease. Or, you could have her pay an additional deposit for pets. Or you can give 60 day notice to vacate. She is in violation of the lease, which voids it. You can rewrite the lease, or get rid of her, it's your call. |

If she agreed "no cats" then she has already broken the lease. You can ask her to get rid of the cat or move. If she moves she is responsible for rent payments until you replace her or her year is up. |

she did break the lease, but if it really doesn't bother you that she has the cat then do a "pet addendum" to add the cat to the lease (our leasing office does this)
if she doesn't want to pay then tell her she will have to remove the cat or move out...if she moves out then you should be able to take her to court for any rent due for the remainder of the lease |

According to any lease I have had if she moves out she is responsible to pay for the rent during the lease period. I would put a no pets clause on your next lease. It was a verbal agreement so it is still binding if you told her no pets. Add up how many months she would have had left in rent and that is what they owe. A lease is a binding legal contract. You have every right to let them out of the lease if you want to. |

Look at your lease, specifically, but I suppose the tenant is liable for a full 12 months of rent, whether they choose to live there or not. Also, what is the date of the signing of the lease, i.e., was it more than three days ago? Most states have a contract release time period, in which the signers can get out of a contract within three days of signing, if it involves a lot of money (like this does).
The tough part is, if the tenant does choose to move out and try to stiff you for the lease, then you have to figure out how to collect. But for 12 months of rent, that would be worth it!
It would be nice to be able to communicate with the new tenant with a more or less "veiled" threat, in other words, you don't explicitly say "I'm going to make you pay for the full 12 months," but you think before you talk, and find some creative ways to imply that you understand that - wow - that must be hard for her (the tenant) to think about this, when she has such a big financial commitment here. You can find a better way to say it, but you know what I'm getting at - not being aggressive, but somehow letting her know that you know your rights. |
