I have a live in girlfriend who I want out of my house. I am currently renting. How can I evict her legally?

reenzz
If your both on the lease...you can not evict her. If you alone are the leaseholder...then you must follow legal eviction procedures as outlined in your local landlord/tenant laws.

INS CSR-L.A. County
If you are the only name on the lease, then she becomes a "dependent" (much like a child) and in order to get her out, you have to go through an eviction process to oust her. A 30 day notice, then if she doesn't leave, take her to court. It could take up to 3-4 months. It's not an easy process.

Yup.. must use the proper channels..

You can't throw her out on the streets.

You don't have to evict her if she's not on the lease ("your house"). If she is then you can ask her move out or you can move out. Pack her stuff, sit it on the doorstep, and change the locks. Good luck!

jadair130
is her name on the lease? if so...your screwed.

If not - then GREAT! same rules apply another person. You lgally have to give her 30 days notice in writing. Have it legally noterised and BAM!

Just like everyone said, if she is on the lease, you can't make her leave. If she is not on the lease, then you have to go thru proper legal channels to evict her if she won't just go when you say Get Out. Of course you run the risk of eviction yourself if the landlord has a problem with you having someone living there who is not on the lease with you.

redcurleyz
If not on the lease just put in writing that she has thirty days notice to leave. If she doesn't move then find out what your land lord tenant laws are in your area. Make sure everything is written down, and you have a copy and she has a copy. That way she can NOT come back and say it was all verbal. What I did when I had to take over a car I bought with an ex boyfriend was made up a document where he and I both signed and recieved a copy and that way it ensure that neither one of us could go after the other.

Good finance question! I know of an organization that gives up to $1500 to people to help them with their rent or mortgage. It's available in most US cities, I highly suggest you check it out.

If she has no lease with you, just say, "I don't to live with you any more. You'll have to leave." If you and she are both on the lease as equal renters, it becomes harder.

If she is not on the rental agreement, just tell her to get her stuff and get out. There is nothing she can do unless her name is on the rental papers. If she refuses to leave, call the local sherriff's dept and have them escort her off the property.
