I have a problem with my landlord-involving mold-rent etc. PLEASE HELP!!?
We just moved into this condo a little over a month ago- 2 weeks ago I was putting things away and found mold. I also determined that the pure filth that I had been cleaning was also mold after speaking to the mold inspector that was sent in. We have asked our landlord for reasonable accomodations which she has not provided. She kept saying she would yet still hasn't come up with anything. We filed a small claim lawsuit against her for the 1st months rent and the deposit because we asked to be let out of the lease and she agreed but refused to give our deposit back. Now that we filed it she refuses to let us out of our lease and won't accept our rent payment and won't make reasonable accomodations. I don't want to be sued for the rest of the lease, but can't continue to live with kids in mold. What do we do from here?

She still has not hired the mold inspector to get rid of the mold either.

It seems that you have started to protect you legal rights, and to safeguard your family.

Take pictures of the effected rooms. Videos are best. For stills, snap overall room photos and then move in closer in stages for close-ups so you can prove the mold is in the location you claim.

Get an inspection from a public/government health inspector but be aware that the inspector may declare the premises unfit for habitation and that you may have to move out on short notice. You can also get a mold removal service to evaluate and make recommendations for eradication. ALWAYS request a copy of the report from each.

In many jurisdictions a renter can perform emergency repairs or services if such work is necessary to make the premises safe and livable. Most courts will allow such costs to be applied against rents due.

I know this might sound a little expensive, but what is the cost compared to your children's health.

1. Call your own inspector and get a report once received send it to the health department of your state along with a complaint.

2. MOVE....you should not risk your health or that of your children because of this woman's non action to your pleas.

3. Take pictures of any of the mold that is visible.

4. Break the lease and keep all items above for proof of this issue if a judgment is placed against you.

Once you report this issue to the state something will be done (hopefully). This is a dangerous health issue and should be addressed ASAP. I would move my children out of harms way (relatives home..etc) until issue is resolved or you move.

Once mold enters a residence the only way to remove is to tear out walls and insulation so you'll need to move one way or the other.

Hopefully you have documentation from the mold inspector that its a toxic mold, you need that report period before you can move on with the law suit

take pictures of the mold, call your city housing on them , they will put a lien on the property not allowing her to sue you until this matter is cleared up. do u have any written documentation from her corresponding to allow you out of your lease. supply all documentation. within a month u will be out of there, money in hand from her withholding and u will be on ur way. be patient, she is in the wrong and once u go to court u will be let out of this ridiculous lease and have ur money returned. she really has no rights to sue u esp since shes refusing to accept ur money. u made good faith to pay. what does she expect? she is not gaining any profit from forcing to live like this. she is an idiot and will soon be exposed.

First, protect your family. A health inspector will determine if the condo is inhabitable. Second, find out if you have a Renter's Union where you are. Third, contact the Better Business Bureau. Your landlord is probably not the owner of the property, so she is not in a position to reimburse you. Find out who the owners of the property are and respond directly to them.

Contact a lawyer and set up an escrow account into which your rent will be deposited until there is resolution. If you are forced to move and the property is found to be at fault, you will have the money in escrow to assist you, and if you are accomodated by the condo's owners, you will have the money in escrow to pay for your lease.

You may also want to contact a civil attorney who deals with slumlords. A free consultation is in order.

Call your local County Health Department, you will find it in the Yellow Pages under County Offices. Ask them to come and inspect the place, and help you with the legal aspects if possible. Mold can cause chronic and fatal illnesses, and no one should have to live in such a place !!

why are you still in the condo. just because of a few hundred dollars? Get out and then work to get your money back.

The mold is either bad enough to get out ASAP or it's not bad enough to worry about. Which is it?

no seriously, the court cant fight all battles, sometimes you gotta get your hands dirty. find some way you could get her by the balls and threaten her with that.
