I have a roomate who drinks, and I rent from him, he took my $500 deposit and spent it, what is my recourse?
I have been renting for about 3 weeks here in Sheridan, WY which is almost impossible to find any kind of housing. He was a nice guy at first, but now it is beginning to be a nightmare. I have an 11 year old boy living with me as well. He has already threatened to kick me out and not pay my $500 back. I told him that if he didn't i would take him to court and put a lean on his property. He stated that I couldn't do that.. He has no income, only what I pay him for rent, which is $250 for each of the 2 bedrooms that I rent from him. He sleeps in a chair everynight, with the TV going, he has type 2 diabetes, which he takes injections for, and drinks about 1/2 gallon every couple days. He didn't drink until I started paying him. When he is drunk, he is beligerent, rude, and obnoxious. I am kind of stuck. I need answers from anyone.

If he spent the $500 that is not the problem. He can do that if he wants. The problem is if he can't come back up with it to give you when you move out. Try making arrangements with him in writing when he is sober where you will live there for one month free if he cannot afford to give you back your deposit. If he refuses, then you can at least show that you attempted to work with him instead of just suing him outright and make you look better to the judge. If he goes for it, then it will also give you $500 extra dollars to find a new place, and time and resources to move out. It is actually a better situation because you can have 2 apartments at once for a month and that will give you time to get your stuff out.

You do need to get out of there, though - it is not good for a child to be in that environment. If he does not work with you or come up with the money then you will have to take him to court to get it back and as long as you have a receipt or canceled check and contract showing that you paid a deposit and witnesses that he sits around drunk all day then you have a good case.

You are not stuck. Get up off your butt sitting in front of this computer and take care of your son by finding a place to call home, Deal with the jerk later and be more careful next time. You have a son to take care of.

if you have written proof of what you pay him (canceled check, money order, receipt, etc) then you have a case.

it might cost you more to go through a court case. i'd move out before paying anything else.

check with your landlord/tenant board. always get a receipt from him and if he won't give one, pay your rent with something that gives you a receipt (check, money order, or cashier's check).

Report it, then leave the home. It's a bad situation for your child to be around. Stealing, drinking, etc... not good at all.

I'm not sure why you would stay around there. Don't assume that he will not give you your deposit back. Was he there before you? Does he own the house? Why do you pay him the deposit and rent? You need to get out of there, I know you say it is hard to find a place, but pretend you have no choice, and start looking. The step after is small claims court.

Well first - do you have everything in writing? Do you have a check stub to prove what it was for? You need something to prove this. Also, if you are renting, you have rights as well too - he can't just kick you out for now reason. But we need more information.

But you have a kid there and he drinks - seems to me that you need to give notice and look for a new place.

If you're that concerned, move out and find somewhere else to live. If there isn't a place where you are to move to, go elsewhere. Living in a condition like that is stupid. You can sue him for the $500 back as long as there was a signed contract of the deposit being returned to you. Otherwise, cut the losses and just get out of there.

you move out you still get your deposit back take him to small claims court..they will if he wont pay go in to his house and take whatever property it takes to come up with 500dollars..i had to do this against a landlord who refused to pay my deposit i took her sorry butt to court and won..she didnt pay i went and filed again and had the money within a week when she realized the garage her and her husband owned would be raided to get my five hundred bucks back to me...so do what you have to do to..you have a child and thats no way for him to live

Report the theft to the police. If you can prove he took the money, by all means, prove it. Start looking for somewhere else to live. There must be somewhere out there. Don't let that useless drunk do this to you. Fight it.

Leave. Then take him to small claims to get your deposit and court costs.

That's your recourse. The first thing is get your child out of that situation. Deal with that jerk later.

And just because he makes nothing doesn't mean he has nothing. I am sure he has a bank account and you can have it garnished. He does get income from rent so you do have options. Don't let him scare you into thinking you don't/

Call the county, they will help you with your tennants rights.

If he owns the property you can put a lien against it. I'd get a lawyer as you may be entitled to more because of all the abuse you've had to put up with as well as legal fees and any other expenses incurred. I'd get out of there ASAP. Doesn't sound healthy.

Not a responsible person. Take something of his and sell it pal. I know that 2 wrongs don't make it right but man, do something. Small claims court and get the !@#$%^& out!
He needs a rude awakening. I'm a christian man and that's just not right exspecialy with an 11 year old having to deal with it. You felt compelled to help him and he is burning you both. Find another soon.

Find a new roommate,you're paying way to much to live with him. Pay your rent with a money order,so that you have a receipt of payment or go to Wal-Mart and get a receipt book and make him sign the receipt before giving him the money. That way you have some proof for legal matters and then you can take action...either way he is probably going to kick you out...but at least you can get some of your money back. Best of Luck.
