I have a service animal and my apartment is saying i have to pay a $200 fee for the animal. Is this legal?
I have been told that they can't charge a fee for having a service animal. Just wondering if anyone knows the legal facts regarding this.

They can not charge, you simply need to give them a copy of the animals certification. Non-certified animals are simply pets, you would be amazed how many people claim "service animal" when it is not the case.

REAL registered service animals are exempt.

But some people who are "depressed" have "companion animals" for "therapy." These are pets and you must pay the fees.

Yes that is very possible, the fee is for if the animals causes any damage and what not.

Only if it is a refundable deposit for possible damage. Even service animals can damage rugs, carpets and walls.

They are allowed to charge the same fee they would anyone else. It is only illegal if they are discriminating by charging more. $200 sounds pretty normal, even on the low side.

The main thing about service animals is that they have to be allowed even when the property normally does not.

You are liable for any pet damage, same as everyone else.

Check with the city, and if you do have to pay one..........make sure its refundable, w/ no damage...........and take pictures before and after..............

If it is a true service animal, the landlord cannot charge you a pet deposit or fee.

What if I have a disability and depend on a service animal?
This is a special situation. Because of federal fair housing laws that require landlords to allow reasonable accommodations for tenants with disabilities, the landlord may not prohibit a service animal from living in the unit or charge the tenant extra rent or deposit.

A service animal should not be considered a pet. The tenant may be required to provide a note from a physician that verifies the service animal is needed as an accommodation to the person with the disability, but the animal need not be a certified service animal.

If the landlord refuses to allow the service animal, you may call the U.S. Dept. of Housing and Urban Development (HUD) at (800) 669-9777 or (800) 927-9275 TTY. HUD has publications available about fair housing and can direct you to your local fair housing office.

Yes, this is very low fee. Animals will be animals and you can't always prevent them from damaging the floors and walls.

When I worked for a property management company, there was an mandatory extra month rent charge for security. Most of the time service animals are larger than the average pet dog or cat. The larger the animal the more damage that they can do.
