I have a tenant that won't pay?
I have a tenant that has hired a lawyer and stated that she will not be paying me my rent for October & November, plus she wants her full security deposit back. Reasons behind this behavior: We've had critter issues in her side of the duplex since February of this year, it started off with bats, then mice, then raccoons, and now finally squirrels...it's finally been verified that it is squirrels...found insulation and walnuts in the upstairs bathroom vanity drawer. I understand her frustration with this, that's why I've spent close to $3000.00 since February with the Critter Control Company trying to fix this problem. She left the window open in a bedroom she was sleeping in and a bat came in while she was sleeping. She killed the bat with a hammer, and the Critter Control guy disposed of it. A day or two later she calls me up and wants me to pay for her to have rabies shots, in case the bat scratched her while she was sleeping...I agreed to this one day later, after consultation. Every time this tenant has had a complaint about a critter noise, it has been about a week before the rent is due, there is a pattern and that's what annoys me more than anything. She has found a convienent way to not pay her rent. I feel I've done everything in my powers to alleviate the problem. What are my options in dealing with this situation? I live in Michigan, and the rental unit was totally remodeled before she moved in, actually since I bought the duplex she has been my only tenant. I admit to a certain point that I felt sorry for her, she was a woman going through a messy divorce with 2 children and I bent over backwards to accommodate her and the situation which was presented to me at the time. Hell, I even gave her a T.V. when she moved in, she had none. I believe she is emotionally unstable and somewhat irrational. The state in question is Michigan

Her lawyer states in the letter I got that she will stay until November 30th, and she expects a full refund of her security deposit. It also states: "If you choose to file a complaint against Ms. Smith, please be advised that we intend to file a counter-complaint carefully detailing the incidents with the bats and the resulting costs to our clients. We also caution you against publishing any information to the credit reporting agencies". The amount we're talking about is $2500 for rent and another $1250 for the security deposit. The reason the bat got in was it's a double hung window and the screen is only on the bottom. She opened it and pushed the top down with no screen for exposure. The letter states that all further correspondence is to be sent to the lawyers office. The lawyer I found out is a personal injury lawyer, go figure.

She's got an attorney, so get yourself one immediately. Make sure they have expertise with real estate. Serve her notice 3,5,7,10, whatever is required in Michigan. Don't know IF MI permits Rent Abatement, most states DON'T. READ the lease carefully. Keep your receipts, your records showing your prompt responses. She is the one who let in bat. Critters typically try to move inside in Fall, and if your housekeeping isn't great, they'll get settled. Squirrels are particularly annoying and difficult to find entryways.

Think about what you are willing to settle with her, to get her out and to avoid court and attorney's fees. Think No. 1 you want her OUT, but it's harder every day she stays to get quality tenants at this time of year. Having a bat or mice is NOT a reason to NOT pay rent, particularly when LL is trying to remedy problem. It might be a reson to break lease without penalty. Have you heard from her Lawyer? He/she should not condone her NOT paying your rent.

Personally they are trying to bully you around. I'd send the lawyer a letter back stating that you have documentation stating your costs due to the tenant's negligence (leaving the window open) which caused the issues. You will forgive the extraneous costs if rent is paid in full. You will consider a full refund of the security deposit if the property is left in the condition in which it was originally rented. If any past due rents are not received in 10 days you will have no choice but to file for eviction.

If you don't get the rent in 10 days, file for eviction.

Contact a real estate attorney. Many will give you an initial consult at no charge. The attorney should give you an idea on what your liabilities are and how much it will cost to defend you position. Be fore warned it may cost less to pay the woman than to hire an attorney. It also may prevent a long drawn out process that will keep you up nights.

Now on a personal note as a landlord. Tenants like this really piss me off. Most of the time they are habitual deadbeats and the lawyer is probably a family member who is also a deadbeat.

before your kindness puts you in the poor-house you need to talk to a lawyer, or someone knowledgeable about the land-lord tenant laws. this way you will really KNOW your rights and responsibilities. you need to go into this armed with the correct information because you are dealing with a bully who is using your lack of information and your kind heart against you. you must be strong. if you stand up for your rights and don't let a bully manipulate your with threats or tears, you will either have a neighbour you can get along with or a new neighbour after you have evicted this bully. did you know that a tenant can not legally withhold rent without PROOF of long standing neglect? there are certain legal restrictions on this, talk to a legal adviser, please

Your belief that she is "emotionally unstable" or "irrational" does not negate the fact that there are verified critter issues in the unit. It is a valid issue, and one that you will have with any tenant who moves in there. No matter how much it costs or how unfair it seems, you have to deal with it.

Consult with a lawyer to see if she is able to withhold the rent or if she has to escrow the money, and to file a non-payment complaint on your behalf.

How does a bat get in through an open window with a screen on it? If there was no screen, there should have been.

It does sound like you've tried to do your part. If the critters are really there, though, you can't blame her for the timing. She's been paying all these months, right?

How does being freaked out about endless critters make her unstable? Even if she is unstable, she has a right to a critter-free place to live. Nothing sounds unstable unless you're suggesting she pulled insulation out of the walls and hid it in the bathroom vanity? You weren't clear about whether that was the case or whether the former owner had left it there.

It's not that she's trying to skip paying the rent, because any lawyer is going to know that she has to put that rent in an escrow account and pay up if you win in court. No lawyer would represent her if she didn't do this, because they'd assume she'd try to weasel out of paying them, too.

Decide if it's more costly to let her out of the lease and return the security deposit, or get your own lawyer and face her in court. You'd have to return her security deposit anyway, unless she did damage to the apartment or left without paying all the rent.

Call her lawyer and ask just what you've done wrong. It always pays to know what the other side is thinking; that way you know what you're fighting. You can also ask if a compromise can be reached and offer to let her out of her lease, if you get rent for the time she was there.It's possible the lawyer, after talking with you, will recommend that to your tenant.
