Usually they don't plow or do any street repairs. The people who live on it cover the costs.
Check with your town, some now also cover private streets. |

Who owns the road? If it is you, you will be 100% responcible for maintenance & liability. If the road is owned by others do you have an access easement? Atty would be your best bet to secure your rights to the road. |

Basically the local Council does not have any legal responsibility for the upkeep of your road. The residents have to look after the upkeep of the road, keep it in reasonable order for use by vehicles. Best is to ask if there is a residents association (with a road fund for repairs) in existance. If NOT start one, is my advice. Good Luck. |

I assume that you are referring to the UK. The law here is that when the road has not been adopted by the council, you have to bear the costs when it comes to repairs and maintenance. There should be covenants covering the conditions for the use of the road and these costs. You should get your solicitor to check them. Normally they are quite straightforward but sometimes you may find an awkward clause. Check if the road is also an access road for other properties down the road, and what your responsibilities are. Also ask if they road has any prospects of being adopted. |

When you open escrow (West Coast) or hire an attorney (East Coast) they will do a title search. This search will reveal any covenants and restrictions that have been placed on that private road. Sometimes the homeowners on that road will have filed very clear financial requirements encumbering owners to help pay for road improvements and maintenance. This is usually spelled out and money can be collected either annually or on an as needed situation. Having an agreement like this is better than not having one. If one neighbor refuses to help pay it can be difficult to collect. Agreements between neighbors also protect if there is an accident on that road or a pothole that damages a car. Private roads can be insured by the homeowners as well. It definitely limits homeowner liability. |

is the home you are looking to buy the only house on that private road? or are there other houses as well? some implications are that if the area is in the north where you will get snow you will need to pay for a private contractor to plow for you (if you don't have a plow of your own) since the city/county will not plow for you. also, if the road develops pot holes you will need to pay for repairs. if there are other homes on the private road the home owners will share the expenses but some may look to pay less rather than an equal share if their home is closer to the public road. |
