I am renting and I have not had a lease for 11 years, within the last year my landlord told me that he wants $50.00 if I am even a day late. Within the last year I have been late 3 times, 2 of the 3 times was a day late and then once was 15 days late. Can he "leagally" do this? What can I do. Additional Details Actually, the reason for my late fee is to pay his late fee at his accountant office. So basically I am paying his late fee. The reason whi I am questioning this is because I am in process of buying a house and moving. |

If you never had a lease that addressed the issue of late fees, your landlord cannot charge one.
He is trying to enforce a one-sided deal. You never agreed to a late fee, and it's his own damn fault that he never had you sign a lease that included a late fee clause.
He can't enforce something that never existed. |

Sadly, unless your state's rental laws specifically forbid it, your landlord can do this. Check with your state government, but restructure your budget so you can pay on time. If you keep track, paying just a little extra may provide you with a cushion (I hate to let my landlord have the use of my money early, but I am two weeks ahead with rent just because my landlord is just as nasty as yours!) (And yes, I'm trying to move!) |

if you have no lease, technically he can kick you out. but, if he just told you about it now, he can't charge you for the other times you were late on your rent.
if you've been living there for 11 years i assume you would have a decent relationship with this guy and could talk to him about it. when my apt started charging me for new things (ie charges for "noise violations", "pet rent") it was because they were trying to kick me out in favor of someone willing to pay more for rent... careful... |

Your local laws can answer that... As a paralegal..., general laws do allow a late fee to be asserted on the day after payment is due... However, some state requires the landlord to disclose the late fee amount prior to the tenant moving in...
in other words, the landlord can do so (but only if...) he/she has informed you before you moved in that a late fee of 50.00 is due if the rent has not been received on time... Otherwise, he maybe in violation of your state laws, which will void out the agreement between you two... |

I am assuming you had a year lease 11 yrs ago with the same person and that the lease turned into a month to month after expiring. Check your lease for a late fee clause. As you have an existing lease that did turn into a MTM, you are still bound by its rules. He can legally charge you the late fee if it is in the lease. He can also give you 30 days notice to move.
If it is not in the lease and you have no lease (past or present), he cannot charge you a late fee without prior written notification. He cannot verbally tell you he is charging late fees. GET EVERYTHING IN WRITING. ALWAYS. He still has to give you 30 days notice to move and he has to go to court to do so. However, if he evicts you through the court, it will go on your credit report automatically. |

Why don't you have a Tenant at will lease?
He can do anything he wants if you have not establish an agreement between you two...
As a Landlord, if you had a lease you can be 15 days late with out a fee......you are stuck right now...
