I have split from my partner and moved out do i have to pay my half of the mortgage
my daughter has split from her boyfriend, they own a house together. she has moved back with me and he has stayed in the house, he has said that he wants to buy her out. does she still have to pay her half of the mortgage as she is not living there.

I would say no. Let him buy her out. It will give her a fresh start.

If her name is on the mortgage, then she is responsible for her half by law. She can't just run away from that like she did the relationship.

She has to pay if she wants to protect her credit. If she trusts her boyfriend to pay it, she will be ok. /

if her name is on the deed she does,if it is she should call the mortgage company to tell them the situation,do not wait because he can ask for the money later,so she should get her name off the mortgage asap

If her name is on the mortgage, then she is responsible no matter what agreement they have made. Until her name is off of there, she can still be accountable for it. But so is the boyfriend as well. Don't assume he is taking care of it. Make sure that her name is off of it before she stops paying for it.

Is her name on the mortgage? If so, she is liable regardless of where she lives. If he is willing to buy her out, then she should go ahead with that option. Have the house appraised, and have him get it refinanced in his name only. He should pay her half of the equity in the house. (equity = appraisal value - mortgage amount)

If her name is on mortgage then , yes. Make sure she pays by check and gets a receipt. She must have proof in case he tries to pull something. She could even make her check out to the mortgage company itself to make sure it gets paid.Never underestamate a Ex.

Good lord, if he wants to buy her out, do it ASAP. Anything else will just get messier and more expensive with time. But it will involve a re-fi to get her name off the mortgage.

Have the home properly appraised to determine her share of the equity. But be aware it may not be much if they haven't lived there long and the property values have decreased. A simple, straight cash offer might earn more for her.

well if he buys her out, then that means she wont need to pay the mortgage.... cuz hes buying her out and she uses that money to pay off her half.... just means the house isnt hers, and its all his....:)

Why not let the guy make an offer?

He may be making a very very generous offer. Then take overnight, to think it over and respond.

Also anything in writing, is future evidence.

If her name is on the bill of sale/lease then yes she definitely has to pay until she gets bought out. If it is a situation where he bought it and she was just helping, he could go the court route but would probably be more expensive than just buying her half out.

I have a joint Mortgage with my partner, he wants to move out but is happy for me to keep the property with our little boy - problem is I have spoken to our mortgage company and they say I can't transfer the mortgage just into my name as my income (x3 and a half) is lower than the balance. Can we have something drawn up with a solicitor to say that he wont be liable for the payments and do I have to contractually tell my mortgage company if he isn't there?
