I have lived in the apartment for 7 years, the carpet is over 10 years old, I asked my land(slum)lord to replace it and he tells me he will go up $50 on my rent monthly if he does. So I replaced it having calculated that it would be cheaper for me to do so verses an extra $50 a month. When I move....can I take it with me? better check you lease concerning major appliances- if you take carpet and leave nothing on the floors - he is sure to charge you for it - big time - you can't take door locks and built in lighting |

If you attached the carpet to the floor it is now a permanent fixture, but why would you want a 10-year-old carpet? If the unit was carpeted with anything when you rented it, you will have to leave it carpeted with something when you leave.
Likewise for the appliances. It sounds like you got tired of dealing with your landlord (I can understand that) but when you bought your own appliances, lighting and locks you no doubt threw away the old ones. So while you can say the fridge is yours because you bought it, it's also true that the apt. came with a fridge and after you leave one has to be there. Same with the lighting, locks, etc.
In choosing to do an end run around the landlord you chose to make an investment in the apartment for your own comfort while you were there. Hopefully that investment paid off and increased your quality of life for the last 7 years, but it doesn't sound like you can take any of it with you. |

You got taken for a RIDE on this place unless you have a non-standard lease. Unless you kept the old appliances and carpet in storage and put them back when you leave you are going to get charged bigtime and probably sued if you "steal" this stuff from your apartment. This is assuming a fairly standard lease. Your landlord should have fixed/replaced these items if needed unless you made other arrangements with him. Not a smart move on a rental property. Anything "new" you didn't replace you got for the place is yours, otherwise you "stole" the origional appliances and carpet. |

You have to return it the way you got it. Trade fixture is business type equipment/items, that wouldn't' apply to you.
He could even claim that you even damaged the apartment when you changed the items in the apartment. Or that you replaced them with inferior items.
If you had problems requiring you to replace appliances and carpet WHY did you stay. |

you cannot take things that are part of the apartment, like the carpet. If it had hardwood floors, and you added carpet over them, yes you then could take the carpet- appliances will be yours to keep, unless you had to replace ones you damaged. If you have the original locks and lights, you can swith them back and keep your newer ones-- |

Here's some answers to your multiple questions...
1) I am not sure on Georgia law, but the land lord is required to replace the carpet after so many years. They can *NOT* charge you for it. Some states it's 5years, some it's 10... some are all over the place in number of years. But basically, the landlord is responsible under "normal wear and tear" to replace carpets at HIS OWN dime, not yours.
2) "go up $50/mo"... he has the right to charge whatever rent he likes, especially since you do not have a signed lease. Basically, you're month-to-month right now. It doesn't matter what reason he comes up with he can charge you whatever you like unless you have it in writing what your lease term is and how much per month your payment is.
3) You are not allowed to change the locks and appliances in a rental unit. The Land lord is the only one allowed to do that. If you have the old locks and appliances, then you can put them all back and take your new stuff with you. However, if you do NOT have the old stuff (major appliances especially!) then you can *NOT* take it with you. If the home was rented to you with appliances, it has to be returned with appliances of equal value, functionality and condition. IF the appliances didn't work and warranted replacement, this should have been done by the landlord, not you. This goes for the lighting too.
4) Your security deposit. After 7 years, most things in the apartment are now under the "normal wear and tear" guidelines so you should get it *ALL* back unless you damaged something in the apartment that requires replacing. Even if you damaged something, you are only able to be charged for your period of the "normal wear and tear." For example, with carpets, let's say the period is 10 years in Georgia (you need to check that), then the landlord can only charge you for 30% of the replacement costs. |

Yucky situation. You should have not been responsible for so many replacements as a renter, but whatever is in your lease... You are not allowed to take any of those items that you listed unfortunately. You may want to contact a local real estate agent or someone with this knowledge that is willing to consult with you. |

I'm not sure what the rules are in GA, but in VA landlords are supposed to (which never happens) change out the carpet and paint the walls when a new tennant comes in. They are also supposed to fix appliances or replace them completely. That's why its renting and not buying.. you don't have to be responsible for that stuff.. I'd say you CAN take it with you. You are not paying your landlord for it so it is not his property. Major appliances I say are DEFINITELY yours |
