The listing agent stated by e-mail that she would take care of paying the window repair company, (I already sent her the estimates from two comapnies). Now I get an e-mail that states I have to pay for it and they will reemburise me. I got upset and sent her the e-mail she had sent me saying that they would take care of it. I want to know if I have any recourse if she sticks to her guns and says that I have to pay for it first?? Help In Arizona. |

Either way you have proof that the real estate agent would pay for the window. I would pay for it, then submit a copy of my receipt with a copy of the e-mail saying they would reimburse you. Then, if they fail to pay you could sue them for the amount of the window, using the e-mail as evidence. |

If it really bothers you, get her to put it in writing that she'll pay for it. But, I would trust her at her word.
Keep in mind that real estate agents get 2.5 to 3% commission on the sale. They also want you to be happy, so you'll refer them to friends and family. She's not going to jack you over for the coupla-few hundred she's out paying for the window herself. Go get it done and send her the receipts. If she refuses to pay, report her to your state Board of Realtors (or at least threaten to - that's like Kryptonite to real estate agents). |

Tell them you want the home in the condition you agreed to buy it in. If you haven't closed than it isn't your home. Tell them you will close when it is in the condition that you agreed to buy it in. Make sure that the replacement is of the same quality as the original.
Your Realtor should be taking care of this with the listing agent. |

If it happened before closing the sellers are responsible. After closing the buyer is. The agent is trying to save every one a lot of grief by paying for this herself. She's paying out of her pocket for something that isn't her responsibility at all. Give her a break and pay for it then send her the bill.
BUT hold on to all the correspondence where she says she'll pay for it, just in case. |

Talk with the broker that represented you in the transaction, if there was one.
Refer to the purchase contract and any relevant addenda to it. Was the promise to pay for the window in writing, or was it verbal?
If it was just verbal, you may have a problem. Most courts in the US will rule that a verbal contract for real property, even if valid, is unenforceable.
And BTW, the window is considered real property since it was attached to the house.
Again, talk to your broker. If that's not possible, call your Division of Real Estate to complain, but only if the agreement as to the window is in writing.
Otherwise, you'll be wasting everyone's time, including yours.

I know that here in NY the owners are responsible for any and all damages to the house until closing. The owners have to pay. Contact your attorney and get them involved. |

Either way, there needed to be a WRITTEN agreement about this. E-mail is absolutely worthless.
Did the closing happen already? If not, you need to get whatever they’re going to do in writing before you close.
If you have closed already, consider yourself lucky they’re still offering anything. If you closed without a written agreement on the subject and without having this resolved, you actually accepted the house as it is.
Your buyer’s agent should be taking care of this. Where are they?? |

If you have picked out a company to do the repair ask them to invoice you, send her that as the bill and when you get paid by her, sign her check over to the glass company. |
