he actually signed the paperwork last night with me that i had a lawyer prepare. he called me today and said that the realtor wants to collect fees because his sign is in the yard. he wants to split this. i don't think i should have to since the realtor is not how i found the house and it is after the contract expired. can he make me partially pay for this realtor i was told didn't exist? keep in mind he already signed the property offer and accepted the terms with no mention of a real estate agent. No, he can't make you pay any fees with the real estate agent. His issue with the real estate agent is totally separate from your agreement. He needs to deal with that separately.
Although he shouldn't owe the agent anything if their agreement has expired (as long as that agent did not arrange for you to view the home while the listing was active) even if he does, sales commissions are the seller's responsibility.
The agreement you have with him stands as signed by both of you. Check with your lawyer and he'll verify this information. |

You as the buyer dont pay the realtor's fees. The fees come out of the sellers proceeds after paying off any mortgages etc. The Realtor may not collect anything depending on when the contract expired and the laws of the state in which you live. I would suggest that you call your local Board of Realtors and ask for their legal department to get more fully informed answer. |

Buyers dont pay realtor fee's unless it is disclosed in the contract and the buyer agree's to pay the fee's seller most pay the fee's based on the points charge Do to the sale of the house or property. If you have a realtor he will share the fee's with the agent who is displaying the house. Dont warry about the seller he cant do any thing if he singed. |

I'm not a lawyer, but work with real estate. First off, talk to the lawyer who drew up your paper work. Don't know what state you live in, but I live in Illinois. Not sure what rights the Realtor would have if the contract expired but sign still in yard, but he may have a valid point about commission. HOWEVER, I don't think you should have to pitch in anything for Realtor. If you bought it through the Realtor the seller would be paying commission. If you have a signed contract with the seller it is my understanding he is obligated to sell to you or you could sue for breach of contract. You really need to talk to your lawyer. It may cost you a little bit now, but it could save you in the long run. |

If the contract is expired it's not your problem. The agency might want to take it up with the seller, but that's his issue not yours.
Tell him to charge him rent for not removing the sign. |

a buyer never pays a fee to a real estate agent, only the seller does. You don't owe anything, the guy is trying to shake you for money. Talk to your lawyer, it will be worth the fee. |
