I let a friend move into my house and now she wont pay rent and I want to kick her out? What can I do legally
We had agreed that she could stay until she was able to pay an agreed rent and now she says she cant pay it and convinced me should would pay less. She has yet to give me any rent money and at this point I just want her out of the house and she wont leave. Do I have to give her a 30 day notice? I own the house, there was never a written agreement on anything.

You need to take her to court and get an eviction. Different states and different rules but she lives there now so you can't just toss her stuff and her out without due process.

if there is no evidence of the agreement, tell her to leave, remove her stuff from your house tell her to leave again, if she dont call the police and get them to remove her.

You can't legally make her pay you anything, but you can legally kick her out.

Believe it or not if you don't have a contract signed by that person you will have trouble using legal methods of eviction.

So you can take the less money and at the same time get her to sign a contract in which you state that rent will go up a modest amount each year.

If she does not sign that then you could (as I did and got away with it) wait until she is out of the house and put all her belongings in boxes and place them out on the street.
That day you must also change the locks on your doors.

Then wait for her to come home. When she does, tell she is on her own and that if she wants she can have her belongings moved to her new adressor just leave them there to be stolen.

In my case I also called the police who were there when the non-payer (it was a guy) came to what he thought was home.

The police were very good. They pleasantly asked hiom if he was a paid tenant and if so would he show them his reciept for the last months rent. Of course he had NONE. Then the police asked him if he had any receipts for ANY months rent and he did not have any.

The police then asked me if theguy could stay if he paid right then and I told them that I had rented the room to someone else and showed them the contract.

Worth a try if you are fearless.

Good luck and make sure in future. Get a contract and a full month's rent.

So the police said that he had better call a truck and find a new place

NO you can pack her things change your locks and sit her things out side if she protests call the police they will inform her she has to leave legally she has no right to be there if you don't want her there this is why you never let friends get to close because it can end up bad in the end but tell her to leave and if not start packing her things if she causes an issue like i said call the police they'll take her to a local shelter

You might have a verbal agreement with her & if so you must give her a written 30 days notice.
If she still won't leave after the 30 days...change the locks & put her stuff in storage & let her know about that where she can get access to it.

Call the cops, get a restraining order. You don't owe her any notice (legally). She's not legally living there.

forget about the police since you're not married to her it's not considered as domestic disturbance if you call them.
and since there is no paper or written agreement involved not 30 days notice will do anything....it's your say against her. your best course is to set a date and time when she have to leave including her personal effects. as soon as the deadline is over the best thing is to change your lock and put her stuff outside in nice garbage bags if you have to.
please don't wait a minute longer, she have to realize that you're serious about this. remember, you are actually giving her the gift for her own good to wake up.

just mentioning this in case your friend did try to take you to court for damages...
you agreed that she could stay ..free until she could pay...and the violation of this was..you could see no effort was being made..or that she is a complete lazy slob???
so if there is a violation of the verbal agreement...
i would pack the bags..put them outside the door..and change the locks..
the police will tell her where a "free shelter" is..
but you do not want to be sued...
now these "shelter homes" are temporary and have rules..and they may phone you and ask why???or the police..

the homeless issue is really serious and especially in winter months........you could end having this ..rebound..and being a "hostage" in your own home..

so..be careful and if your sure..there is a violation..then ..
yep back the bags..put them out the door and change the locks.........

It's your place. You own it. She's out as long as you can emotionally handle it.

A possible problem could be if she has children, even if they are not yours. There are horror stories (my brother-in-law was involved in one) where the police and even judges told the homeowner that a mother with dependent children had to be provided shelter.... he was forced to leave his home for a month while she arranged housing. ... she took her stuff, the beds, dressers, refrigerator, stove, electronics, kitchen table and chairs, emptied the garage of tools and lawn mowers, her kids punched out the drywalll and smashed the light fixtures ... not a pretty situation....

Man she is ur friend try to sort it out. But if you are the house owner with no agreement u can kick her out anytime. Its just too bad you wont get your rental money since there is no rental agreement

Please note that all of the above information LEGALLY speaking is not correct. A verbal agreement is legally as binding at a written one.

You two had a verbal contract, if she however does not withhold her end of the contract you can take her to court.
