hey you guys
I let my sister live in my house rent free cause she left her bum husband, but now she going back 2 him and?
she says she is having to stay in her car because she doesn't want to live with him but only a few days out of week and she wants to continue to stay in my house. This house is my hubby and I's second home. We do not live there, but we come there for vacations.

She is also getting an attorney because she said I have thrown her out because she went back to her husband. I am not, I just want the house back. This was all verbal and no one signed anything, heck she dint have to pay rent, no utils, I was just doing her a favor?

Will she win if she takes me to court? I mean our relationship will be OVER CAUSE I DONT PLAY THAT, but does she have a shot at winning compensation from me. She is a deadbeat herself. By the way, I am white, worKing class american who gets NOTHING FREE.

Any judge with half a brain will throw out the case. She has no rights to anything that is yours. Your generosity to allow her to stay in your house is not a contract. Unless there is a written contract that shows she has leased/rented the house from you for a certain period of time, during which you have thrown her out, there is no case. Get the locks changed immediately. You also have the right to call the police if she continue to traspass on your property. I know this is a harsh way to deal with family but it might get her to see that you are serious...especially if she is threatening to take you to court. If she does end up taking you to court, having police records that show she trespassed onto property she had no legal rights to will benifit your position/defense.

Don't worry, unless she takes this to small claims court without an attorney, I couldn't immagine an attorney that would take her case knowing the facts and knowing she doesn't have any money to pay legal fees.

If you guys can afford two homes, you can afford a lawyer. You should not be required to support your sister. She is apparently grown and if she is an idiot then she needs to deal with the consequences, not hold you responsible.

It's your sister, not your child. If she is a minor, it is your parents problem, not yours. Her name is not on the deed. she does not have squatter's rights. No good deed goes unpunished.... Your sister feels like you owe her. Apparently that same faulty logic has led her to chase after the loser hubby. She has serious issues and she should not be making them yours.

If you were letting her stay there out of the goodness of your heart and there was no compensation agreement, that part is clear. If she is adult (we assume, since she is married), you have no legal requirement to provide meaningful support. If she's going to take that attitude, let her go pay a lawyer to laugh in her face. It's a bluff, and she won't get anywhere.

She wont get sh*t, it wasnt hers and she cant be mad just cuz she cant freeload anymore. Especially if everything is in yours & your hubbys name, what does she have to prove that she should get something? If anything she probably doesnt even have a checking account to show that she's put out any money towards your house.

i don't think she can claim anything from you considering there are no papers signed or anything. Don't worry. She would have to show proof of payment and if she hasn't given you anything then that is that. I think she is just venting out and threatening you just to defend herself, she's got nothing to prove. I hope everything works out for both of you. I think she needs your help but you've probably had it with her and can no longer be there for her nothing wrong with that either you've tried your best.

Your sister sounds like someone who expects everyone around her to adjust to her needs. You let her stay in your home when she left her husband. When she returned to him, she no longer needed the home. Even with the way she's framed the situation, you sound totally justified in telling her she can no longer use the home. She's just using threats to try and get her way. Her extreme immaturity and irresponsibility is likely due to the fact that she gets her way when she acts like a baby. It's time for sister to grow up.

If she does file a claim, you should file a counter-claim for back rent.

Ok, when she LEFT voluntarily, that is where you obligation ended.

That is called VACATING a premesis voluntarily. The next day, she no longer had a legal right to be there.

You didn't ask her to leave, she voluntarily removed her things, she paid you no money, so she CANNOT get an attorney (and think about it...she isn't going to be able to afford one if she is sleeping in her car) to sue you to force you to allow her to live there.

Let her take you to court, if she figures out a way to get an attorney.

She will lose.

First of all you were doing her a favor. Why are you going to retrack the favor just because she is trying to work things out with her husband. You don't have to like him or their relationship, but there is a reason she married him. I would be proud and supportive that she is trying to work it out. If you aren't staying at the house, what does it matter if she does a few nights a week. I think it's really sad that you would take it so far as to going to court. Very sad. Why not ask her to start paying some of the bills? She will either do it, which will help you out, or she'll decide to move out. It's better than taking her to court. Very selfish.

This is sad. You have a SECOND home and this woman, your SISTER, is trying to sue you for YOU letting her stay in it, after she VOLUNTARILY left?

No, she has no chance, unless she's so slick she can "prove" the stuff all belongs to her. No chance whatsoever.
