I live in NY. If I refuse to pay fine that was levied from my townhouse association - what can they do?
I have heard that some associations can forclose on your home over fees not paid. But I don't believe that is in NY.

You would be wise to check the regulations as they apply to you.

I do not think they would put bylaws in place, that were unenforceable.

You obviously agreed to abide by them when you purchased the town house.

they can due 2 things

- put a judgement against you which will hurt your credit

or

- put the balance owed on your tax bill which is now a lien agianst your property.

In addition, they can prohibit you from using common areas. In the two condo development I have lived in, this included use of the parking lot. Any car on the parking lot could be - and was - towed.

They can and will put a lien on your property. More than likely you won't be forclosed upon but when and if you chose to sale the property you will be required to satisfy the lien and any incurred costs (legal, interest, etc.). This fine could end up costing you much more at the time of closing and you will have to spend time getting it released.

They can go to court and if they can prove that the fine was justified and in accordance with the rules to which you agree, the court will judge in their favor. You may even have to pay the court costs. If you can prove to the court that the fine is improper or not justified, you will be relieved of the obligation to pay.

Yes it can happen. Its drastic and if the association wants you out, they could foreclose on your home. What happens is when you don't pay the fine,they put a lien on your townhome and then since you refuse to pay it, as a lien holder, they can foreclose on it. The difference between states is the amount of the fine and how soon they can foreclose. But it is very possible.

Read the contract you made with the association.

they can and will take you to court..remember you may own your town house but not the land. this will amke it difficult in court. owning in a development also locks you into thier rules and regulations which included fees and such.
