I live in Sacramento, CA and am renting a house. Who's reponsiblity is it to pay for the gardener?

Generally the lease will state that the tenant is responsible for up keep. I even have a clause if they uck it up I will hire a gardener, at their expense.

This is only for a house, apartments are differant, the landlord pays.

Your lease should cover who's responsibility it is to take care of the lawn/landscape maintenance. If it doesn't then you are responsible because the lease tells you EVERYTHING that is included.

This guideline is intended to clarify the responsibilities of the landlord and tenant regarding maintenance, cleaning, and repairs of residential property and manufactured home parks, and obligations with respect to services and facilities1.
The Landlord is responsible for ensuring that rental units and property, or manufactured home sites and parks, meet “health, safety and housing standards” established by law, and are reasonably suitable for occupation given the nature and location of the property. The tenant must maintain "reasonable health, cleanliness and sanitary standards" throughout the rental unit or site, and property or park. The tenant is generally responsible for paying cleaning costs where the property is left at the end of the tenancy in a condition that does not comply with that standard. The tenant is also generally required to pay for repairs where damages are caused, either deliberately or as a result of neglect, by the tenant or his or her guest. The tenant is not responsible for reasonable wear and tear to the rental unit or site.

While not CA, I believe it applies here.
One additional note: You should not have to pay for a gardner since you can maintain the garden yourself.

It depends on the lease. Generally, the tenant is responsible for maintaining the house (and garden) . . . this is no different than the tenant washing the floors and taking out the trash. Otherwise, one should be living in a high-rise that has maid services.

However, if there is a prized garden, the landlord may want to write into the lease that a gardner will do A, B, C . . . once a week/monthly . . .

Now, if you find a larger expense -- i.e., a large tree that needs to be pruned, this would be like if the house needed to be re-roofed -- the landlord should be responsible for pruning and taking the limbs away.

Check out your local rent board/authority.

Look in your lease. If there is nothing about you being responsible in the lease, and you didn't hire the gardener, then it would be the land lords responsibility. If you hired the gardener, its your responsibility. Most house rentals have something in the lease stating if the tenant is responsible for exterior maintenance, such as lawn care.

What does the lease say? If it is absolutely silent I say the owner, because he is the one the city goes after.

it depends on your lease terms; if the landlord will provide the upkeep, the lease will specify this. Most times the renter is responsible for the maintenance of the house interior and exterior yardwork. If you are renting a house, then you are typically responsible for making sure the plants don't completely wither and die, and complying with the local ordinances.Major repairs in the garden like cutting down diseased trees are probably the landlord's responsibility, but mowing, trimming, sweeping is the tenant's.

Per California state law: Tenants are required by law to take reasonable care of their rental units, as well as common areas such as hallways and outside areas.

What will decide who pays for the gardener is the contract that you established with your landlord before you started renting the house. If there is no specification that you have to pay the gardener, then you are not obligated to pay him. The landlord also wouldn't be obligated to pay him(I don't think), but it would probably benefit him economically to do so.

Normally the tenant is responsible for the upkeep of the yards..but if the landlord has contract with the gardening company then the landlord is responsible..you will have to look at the contract regarding outside maintenance. if there is nothing that states who is responsible then you are and can tell the gardener to get lost.

If you hired the gardener, then it's your responsibility to pay him/her.
If the landlord did the hiring, then it's his. However, he can recoup the costs through a rent increase.

i'd say you and the landlord do a 50/50 split. 50% from you because you live there and 50% from the landlord because he owns the damn thing :)

ps...there is no real golden rule for this. it's all a negotiation process.

this is an easy one. The house does not belong to you. There fore the landlord has to pay for upkeep. If he chooses not to, then that's his problem. And I'm sure he will here it from the neighbors if he does not keep it up.
