People who know both of us, have told me that where he is planning on building, is like 75 feet over into my property. I own several acres, and I don't think he knows where the boundry is. Where I live if you are going to build a new structure you have to have the land surveyed to make sure you are building on your land. I would think that would be true for most places. If your neighbor doesn't check and builds it on your property you could make him move it. |

Generally before building permits are issued the land is surveyed for boundaries. Anyone mortgaging him that house does not want problems with ownership. You should talk to him now and go to the city planning office and see the permits. |

That would never stand up in a court of law, which is where it would end, if you waited to tell him, until he'd nearly finished building.
As a responsible property owner you are expected to voice your opinions on plans, prior to the local authority giving planning consent. That's the whole point of the planning process. If your local authority, has not contacted you, as a neighbor, for your opinion, I would contact them.
It's a case of speak now, or, forever hold your peace. |

He has to get permits from the County and they are not going to approve something that is not on land that he owns.....I too live in the country and property lines are often hard to figure out, so IF he doesn't already know, the county will not allow it. |

If you know prior to him building and withhold the information in order to make a profit, you can be held liable, and it can constitute a waiver of the land (I'm being perfectly serious, call an attorney of real estate law for more information).
DISCLOSURE = THE MOST IMPORTANT THING you can do in real estate if you want to keep your land rights and avoid a lawsuit.
You need to tell the city - the city should not have approved the building permit if it involved land that was not his. A surveyor will be hired (at the expense of the city/county) to resurvey the land according to your respective deeds. |

most local Governments will require a survey and a copy of the plans for the house, before they issue a building permit, you must also be sure you own the land, a lot of old metes and bounds legal descriptions for properties might be hard to prove |

just because hes planning on building doesn't mean he can the deed will/should describe the land boundaries and proper research is required because the deed is not always correct so i would talk to the person first and get a research company to make sure of the land boundaries before you end up in the courts |

Double check with town hall on this first. If you have a survey that will help too. If you are correct, notify him as soon as possible. Try to prevent any problems before they start. It is called being a good neighbor. |

Let him know your concern and find your survey of your property. If you don't have one then verify his. Do not wait until construction begins or ends to rectify this issue. It will only lead to bad feelings on both sides.
