If your lease has expired, then you are known as a month to month tenant. Many of the terms of the original lease are still in affect, such as the rent. As a month to month tenant, you must give proper notice that you will be leaving, which is defined as a full month's notice. That means that if you wish to vacate on November 1, then you should have given notice no later than September 30th. October 1 would be too late. |

Yes you are still responsible to give proper notice as outlined in your original lease or state law. ALL states require you give some type of notice. |

Yes you do still have to live up to all the rest of the terms and conditions of your original lease, but they cannot charge any kind of lease break charges. After 10 yr I'm sure you were on a month to month, unless you signed a new lease at some point. You still needed to give 30 days notice. Typically all they can do to you is keep your deposit for lack of proper notice.
Take this as a lesson learned and ALWAYS give proper notice in the future. |

A lease or a rental contract there is a difference.
10 years ago you might have told the managers you would give 30 days notice but that is about all they could hold you to, hope you kept a copy and if you had a good enough reason like the place didn't have hot water, roaches, other vermin or any other health hazard you could have a good case to move without notice. |

The lease you signed 10 years ago was probably only for one year. I doubt you signed an 11-year lease. Look at your lease or ask for a copy of it if you can't find your copy. After the end of the lease you were considered month to month because the lease had expired. It might not have had an end date but I'm pretty sure it did. You can not be held for breach of contract after the contract has ended. Without a lease in place you can move out at anytime. However, the lease probably stated that you had to give a 30 day notice and a forwarding address to get you deposit back. That is the only thing you forfeited. |
