I moved into my apt. 1 month ago. I haven't broken the lease, but my landlord is evicting me. What can I do?
In the lease it says my fiance and I can have no more than 4 kids everyother weekend. We have a total of 6. We had 4 of them over this weekend and the landlord came to our door telling us we have 2 weeks to evacuate the premises. We have no where to go and don't know what to do. What state are you in? This is important. Nobody will be able to answer the question without that. I agree with everybody follow your lease. Make the burden of proof on the landlord. Refuse to leave but still pay your rent, if they refuse your rent payments pay it to a third party attorney in trust.

Make them prove you broke the lease. What is your state and read your state laws carefully. What they put in their lease is trumped by state law. 2 weeks doesnt make sense, I think the landlord is hoping you go away peaceful. I say fight for it.

Give me your state I will get your laws. Or you can google this. *Tenant Landloard rights (your state)* I would also call the dept of consumer protection for your state.

Make your landlord do it legally. Even if you did break your lease he may not be willing to take you to court because of all the regulations and say okay. Make the landlord fight you tooth and nail.

But at this point never miss rent

Get a copy of the landlord/tenant rights for your state and immediately mail him a copy. You want to go on the offensive and show you are going to know your rights and assert them. You need to communicate with him, too. He will have to take you to court to evict you I believe, so just stick to your lease in every way. Go read it again right now and make sure even the kids know how to behave and treat the property, neighbors, etc. In the meantime, start looking for a Plan B!

There isn't a whole lot that you can do at this point.
Obide by the rules of the lease, and he will have to take you to court.
He will have to follow the law in evicting you, he can't just change your locks. If he does, you can take him to court, and most likely, win.

I would try contacting him in writing, stating that you would like to work this out, it might help you out if he does do something outside the law and changes the locks and or removes your property from the premises.

Let him know in writing that you want to work this out and that you are not just going to up and leave at his request when you are obiding to the rules in the lease.

you should get a copy of your lease and go over it really well. Also my dad rents an appartment and the hardest thing in the world is evicting a person. First he HAS to give you 30 days notice. Then once that has happened, if you STAY he has to file with the police saying you haven't left. Then they courts have to set a date so you can both argue your points as to if you broke the lease agreement and he has the right to evict you. Once that is all done if the judge rules in his favor most often the court will give two or four weeks for you to move out. So he can't just say get out in two weeks.

Everyone posting is correct. One item is if you live in a multi-unit building the question might be one of disturbing the other tenants.

I rent property and have recently had a case where a new tenant allowed his children to jump off the bed. This went on for an entire weekend. Come Monday morning every tenant around him was complaining.

I offered the man, who was on the 3rd floor to move to a ground floor unit and when he refused I had to evict.

Send him a certified letter asking him to detail the violation of the lease for you.

Maybe it is a simple misunderstanding and you can work it out.

He has to go thru the eviction process in order for you vacate the property must be court order. Although you may have violated the lease agreement with so many children I would think something else is going on considering I own investment properties and frankly most landlords dont' want vacate properties it cost us time and money. IT IS THE JUDGE that will determine if you go or stay, I would make sure your rent is still continually paid.

Depending on your state, you should check tenant rights. The usual notice is 30 days. The sad part is that its his property and he has the power to get his property back. Check your lease on termination notice.
