I moved into my rented house on 1st February and this is my last month in the tenancy - when do i vacate by?
If i moved in on the 1st of the month, can i stay legally until midnight on the 31st of this month, or can landlord insist i give keys back on morning of 31st?

If your lease is month to month, you have till midnight the 31st! Good Luck

I am a landlord. Usually, tenants do not stay until the stroke of midnight on the 31st. I guess you could stay until midnight, but as a practical matter most the tenants usually leave sometime during the day on the 31st. Sometimes a few days before....never after.

Give him the keys after you have moved all your stuff out on the 31st, and after you have had a run-through inspection with him to get your deposit back.

Technically you can stay until mignight but this is impractical as surrendering the tenancy involves handing back the keys which very few Landlords will let you do at on the stroke of 12 and do you really want to be moving in the middle of the night.

Make an arrangement with your Landlord for a time to return the property to him. If you need extra time to move out, you can usually arrange to pay an extra day or two's rent unless there is someone ready to move in straight away.

Most agents will expect you to move out by midday on the last day of the tenancy but everything is negotiable. Good Luck!

I would say on the first, if your lease says "on or before the 1st". Have you given your landlord notice that you will be moving out? Most places, even if it is in the lease that it expires on a certain day require that you still give a 30 day notice or they could try to fight you on giving your deposit back. Have you looked around for a new place to stay? Keep in mind that you might have to be put on a waiting list if it is an apartment, duplex or something like that. I know, I'm being a worrier, but my husband is the type that likes to leave things until the last minute, and sometimes it causes problems.

I think you're entitled to stay until midnight on the 31st, because you've paid up until the1st of the next month.

It would be expected that you have vacated the premises by 1st September so that a new tenant could take up occupation on that day.

Read your rental or lease agreement.

It's actually very unusual that your tenancy would be up in 7 months. It's usually six months or a year. Legally you have until the stroke of midnight on the 31st. Tenant's usually will move most of their belongings at the end of the month and reserve the 31st or last day for the cleaning and inspection if any from the landlord.
Here is one little thing to think about. Some landlords do not have duplicate keys to where you have rented. They also may not want to be disturbed at the stroke of midnight so it might become a problem to return the rental keys. Be sure to check ahead of time how this will be handled so you will not be charged for not returning the key.

The latter probably. My landlord and I agreed a mutual vacate date for any property I stayed in, and I was out in time.

12 months in a year... 24 hours in a day..the 31st of january marks your last day.You were living there feb1st,,or had the right to..so when that day approaches again,,you have no right to be there.
