I moved out of my rental and the landlord is charging me for some plants that died, can he do that?
He had the sprinklers programmed to run 2x's a day, I couldn't afford that. It wasn't on the rental agreement to water the plants that much. Now he's holding almost $200 from the deposit, which includes some confetti in the grass from a party we had? Is this legal to do?

Yes, this would be legal in CA. The confetti is liter that had to be removed. The lawn is part of the property in which you agreed to leave in the same condition as it was in when you first rented it.

If you can't afford to water a lawn you might want to stick with apartments.

if the sprinklers were programed to do that when you moved in then you had no right to change it without his permission and your responsible for destroying and not keeping his property in the shape it was when you got it

Was it a house? If it was, then yes he can.

When you rent a house, you agree to keep up ALL of the maintenance...not just the parts that you feel like paying for.

Landscaping plants are expensive, and if you shut off the water without his permission, then yes, he can charge you.

$200, is reasonable.

Read your lease. Most of them have a clause about taking care of the landscaping.

If there was such a clause and you changed the sprinkler settings and the plants died, then yes, you're liable. I don't think he can nail you for the entire cost of replacement, however.

With regards to withholding deposit, if you were to go to court, he would be required to show a receipt showing expenses. If it cost him $200 to remove the confetti and replace the plants, yes, it's perfectly legal to do.

If it was written in your agreement the sprinklers were to run two times a day then yes...whatever was signed and agreed to by you is what you are responsible for...if not in the papers, you are not responsible and he cannot withhold your money.

He has to provide you with statements showing how much it cost him to clean up the confetti if he wants to charge you. Any time a landlord takes your deposit they are required to present you with an itemized statement of everything they are withholding and the receipts to show the amounts. Most states have a statute of limitations on how long a landlord has to provide those documents or they have to refund your deposit (CA is 21 days). If he cant prove that you put the confetti in the grass then dispute the charge. You may have to go to small claims court to get it back but you should be able to.
