I need advise please......I am in a terrible rental situation!?
I am currently in a rental home that is pretty pricey. Last week, my husbands health issues resurfaced from a couple of years ago. I tried talking to the realty co. to explain my situation and how I will no longer be able to afford the rent but they basically told me that it seemed like a problem that I needed to figure out b/c I was on a year long lease and I couldnt break it. The lady also told me that if I broke it, they would file a case against me and I would never be able to rent again b/c it will state on my credit report that I have a broken lease. I am so worried now b/c I know that I wont have the money to pay her for the month and I have 5 kids to worry about on where I will take them. Any advise please...I am so scared for my family. I dont wanna end up in the streets! I found a cheaper home that will save me $450 a month but its short term and then I will have to worry about where we will go next with that broken lease on my record.........HELP!!!!!

The advice to see if you can find someone to sub-lease is a good idea so long as your lease provides for you to be able to do so. Some lease agreements prohibt sub-leasing as part of the terms and therefor that option would not be available for you.

I am sorry to hear of your husbands health, and on top of that it seems you are dealing with an unproffesional Property Mangement Company. They should allow you to break your lease and agree to a payment plan to recover the lost rent. That way they can move in a tennant who can afford the rent and pay on time vs having to pay attorneys fees to evict you or file against your credit.

As the Owner of Property Management Company I would suggest you speak to someone else in the office and inform them that you are willing to negoiate a payment plan and if you default then they can send you to a collection company. It is true that you will have a very hard if not impossible time renting elsewhere with a charge off or judgement from another Landlord so you will want to make good on the payment plan they agree to.

It all depends of where you are living....if it comes down to this, then i would think about doing it..... They are trying to scare you....yes they may file the papers to collect from you...but

Start by saying: : Since (the ladies name) has notified me that she will file a case against me, so that i would never be able to rent again, and also states that it will be on my credit report saying that i broke a lease, I am notifying the realty company that i can no longer stay in this house because of the situation i am in now.
(Then explain your problems) Sign it, in front of a notory. have a copy for yourself, and give it to the realty office. In person. Then wait for a responce, if none, or it is harassment only, write another letter saying that you hoped for good results but now you have to move and the hopes that someone else may rent the unit so money will not be lost and that you can no longer pay the amount by yourself.BEFORE doing the letter...
Get some help from your social services.....they sometimes help out with rent also...get in contact with them, meet with them, they may even enter on your behalf to pay the rent or get you out of there.
You may have to get a referral to get help from the Salvation Army. or a church...the social services can help with that also.
Relax and think positive. There are ways out there to get help so don't panic and keep your mind clear. Don't forget Him...God is there for you and your family....

try public housing, i don't know know how much your income is but they can help you find aplace base on your income and if you have 5 kids they willlhelp you find a bigger place and they help you with the rent, i don't know whaty state are you from but i'm sure they have this services it may soound low right now but is better than living in the streets, i'm in illinois this is their phone number here maybe they cna help you locate a place in your area where they can help you 217 2433338 morgan housing authority explin your situation maybe they can help you i wish you guys the best of luck and don't worry god is always there no matter what..

Go talk to the Broker of the realty company and explain your situation. Not only was the agent rude to you the least she could of done was really think about your situation and what she could do for you. I know that isn't the only rental they have and they do have other places available to offer you so don't let her push you around. You weren't planning on your husband to have his health issues again so its not like you are refusing. You were upfront about the situation. Have his doctor send letter to the realty company explaining that his health issues are a major concern and that his doctor would appreciate it if there was less stress to deal with at this time. Atthe very least it will help you to move in to the place you said you found. Besides they have to give you a written notice and it takes anywhere from 45-90 days to evict you. Just keep track of all conversations, phone calls, letters, memos, emails, etc so that if you do go to court you will have just as much ground to stand on as the realty company.

Yes, I realize you signed a year lease, but reread your lease. There may be a clause in there somewhere that states something in regards to medical or health issues.

Wow! You are in quite a bind! You did the right thing by talking with your realty company...but unfortunately, they are in the business of collecting the money for the home owner who has the place for lease. If you signed a lease then, yes, they can file a lawsuit and it will show up on your credit report. I was in a simlar situation a few years ago and what I did was find another place cheaper, with a one year lease, and once that year had passed, stayed and resigned for another year. This helped to offset the bad rating I was getting from "jumping lease". And, I've rented other housing since that time with no problem. Good luck!

I would first check to see if you can sublease the apartment. Is craigslist.com popular in your area? List it on craigslist with a good pictures of the place and you may get lucky in finding someone to take over your lease.

Then the question is what you can do to satisfy your payments. I'd suggest seeing if you have other areas you can downsize (sell car to buy a cheaper one, eat out less, taking public transportation, etc.) - basically anything else in your budget that you can trim out.

I think the main thing is that you know you need to downsize to live within your means. If you care about your credit, I would not tell the landlord you cannot (and will not) pay, but pay part of the rent, show them the budget you have worked up (and what you are doing to save more) and try to get them to work with you on satisfying the lease before reporting negatively on your credit.

Just sub-lease the place to somebody who's willing to pay the price. Pretty easy to do. That way you can move while somebody pays your lease until it's up. Then you don't renew the lease.

What you need to do is find somebody to rent the place that you are leaving -- and it must be someone who meets the landlord's qualifications. Advertise for free on Craigslist, put up announcements on laundromat bulletin boards -- do whatever you can to find a tenant to take over your lease. Good luck to you and your family. Note that this is not a "sublease." Most rental agreements don't permit tentants to sublease to anyone. This is simply prospecting for a tenant.

My sister was also in the same situation with her boyfriend and she asked to have the rent lowered. However you are in a binding agreement and they can sue you for the remainder of the balance you owe. My sister had to pay. She was lucky her boyfriend helped her out. Your in a mess and I don't think there is anything you can do. I wouldn't say you will never be able to rent again but they can make you pay what you agreed. Maybe different states are different but my sister didn't get away with her agreement. They put a lawsuit on her and she had to pay eventually. I would just move out where you can afford to live now and catch up with them later. What else can you do. Maybe they will work with you if you promise to pay them later.

I'm sorry that your realty co is not more sympathetic to your situation.
i would try and move out into the cheaper home that you have found.it is the best short term solution.you will find yourself stressing less about money which is one problem overcome.
i don't know exactly how they do background checks in the US but here in Australia the real estate goes by the people you write down as a rental reference.so here's my idea: if in the long run you do find yourself looking to live somewhere else,write down a friend or relative ( obviously with a different last name) as a landlord stating you are an excellent tenant and have been renting there for years paying ( insert average US rent amount ) per month.
